HomeMy WebLinkAbout099 - 06/02/1998 - AUTHORIZING THE CONVEYANCE OF A NON-EXCLUSIVE EASEMENT FOR A SANITARY SEWERLINE TO THE BOXELDER SANI ORDINANCE NO. 99, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CONVEYANCE OF A NON-EXCLUSIVE EASEMENT FOR A SANITARY SEWERLINE TO THE BOXELDER SANITATION DISTRICT WHEREAS, the City of Fort Collins is the owner of that certain parcel of real property located in Larimer County, Colorado, known as the Archery Range; and WHEREAS, the Boxelder Sanitation District wishes to acquire an easement under and through a portion of the Archery Range as described on Exhibit "A," attached hereto and incorporated herein by this reference ("the Easement"), for a sanitary sewerline to provide service to the Colorado Department of Transportation's rest area; and WHEREAS, in exchange for the Easement, Boxelder Sanitation district has agreed to pay to the City the amount of S1,451; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or other disposition of real property owned by the City is in the best interest of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY "THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the conveyance of the Easement, as described on Exhibit "A," is in the best interest of the City of Fort Collins. Section 2. That the City Manager be, and hereby is, authorized to execute an easement agreement conveying to Boxelder Sanitation District a non-exclusive easement for a sanitary sewerline under and through the property described on Exhibit"A,"which easement agreement shall include such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary to protect the interests of the City.
