HomeMy WebLinkAbout114 - 09/19/2000 - APPROPRIATING UNANTICIPATED REVENUE FROM THE COLORADO DIVISION OF WILDLIFE TO INSTALL AN OZONE AERAT ORDINANCE NO. 114, 2000 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND BUILDING COMMUNITY CHOICES COMMUNITY PARK IMPROVEMENTS CAPITAL PROJECT AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS TO BE USED TO INSTALL AN OZONE AERATION SYSTEM AND STOCKING OF OF FISH TO IMPROVE THE WATER QUALITY AND FISHERY IN SHELDON LAKE WHEREAS, the water quality and condition of Sheldon Lake at City Park has deteriorated over the past two decades from various sources of pollution; and WHEREAS, the pollution and deterioration of the water quality at Sheldon Lake has adversely affected the aesthetics and fishery at the lake; and WHEREAS, the City applied for federal grants funds for the improvement of fisheries and recreational fishing opportunities in Colorado from the Colorado Division of Wildlife through its Fishing is Fun Program; and WHEREAS, the Colorado Division of Wildlife has made available to the City, the sum of forty-two thousand five hundred dollars ($42,500) in federal Sportfish Restoration Project grant funds through its Fishing is Fund Program to be used to design and install an ozone aeration system to the lake bed of Sheldon Lake and provide fish stocking (the "Project"); and WHEREAS,the aforementioned grant funds require a local match,totaling$47,500,and the City's Park Maintenance Division will provide in-kind services,totaling$1,760,for the design and engineering of the Project, resulting in a total Project cost of$91,760; and WHEREAS, the local match, totaling $47,500, is appropriated and available in the Capital Projects Fund Building Community Choices, Community Parks capital project; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS,it is the desire of the Council to appropriate the sum of forty-two thousand five hundred dollars($42,500)from unanticipated revenue in the form of grants funds from the Colorado Division of Wildlife and authorize the transfer of one thousand seven hundred sixty dollars($1,760) from the City's General Fund to the Capital Projects Fund Building Community Choices, Community Parks capital project to be used with existing appropriations to design and install an ozone aeration system and provide for the stocking of fish at Sheldon Lake. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund Building Community Choices,Community Parks capital project,the sum of FORTY-TWO THOUSAND FIVE HUNDRED DOLLARS ($42,500), representing grant fund funds from the Colorado Division of Wildlife Fishing is Fun Program,to be used to install an ozone aeration system and providing for the stocking of fish at Sheldon Lake. Section 2. That the unexpended appropriated amount of ONE THOUSAND SEVEN HUNDRED SIXTY DOLLARS ($1,760) is hereby authorized for transfer from the General Fund Parks Maintenance 2000 budget to the Capital Projects Fund Building Community Choices, Community Parks capital project, to be used to install an ozone aeration system and providing for the stocking of fish at Sheldon Lake. Introduced and considered favorably on first reading and ordered published this 5th day of September, A.D. 2000, and to be presented for final passage on the 19th day of September, A.D. 2000.
