HomeMy WebLinkAbout135 - 09/01/1998 - APPROPRIATING UNANTICIPATED REVENUE AND PRIOR YEAR RESERVES AND AUTHORIZING THE TRANSFER OF APPROPRI ORDINANCE NO. 13 5, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE AND PRIOR YEAR RESERVES AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS FOR THE GATEWAY PARK PROJECT WHEREAS,the City of Fort Collins owns property located approximately five miles up the Poudre Canyon,which property was formerly known as the City's Water Treatment Plant No. 1 and is currently identified as Gateway Park; and WHEREAS, the City wishes to make this property accessible to the public,which requires the development of a new, safe entryway and restoration work at the site; and WHEREAS, the total cost of this Gateway Park Project ("the Project") is $1,120,000; and WHEREAS, 1998 funds have been identified in the amount of$664,000 and the remaining funds, in the amount of$456,000, are anticipated to be available in 1999 and in the year 2000; and WHEREAS,this ordinance appropriates the funds which are available in 1998,in the amount of$664,000, which include $200,000 from General Fund prior year reserves, $210,000 from the Open Lands Fund, $110,000 from the Conservation Trust Fund, and $144,000 from federal grant funds passed through Colorado Department of Transportation; and WHEREAS, in 1995, County residents approved a 0.25 cent county-wide sales and use tax to be used for open space, natural areas, wildlife habitat, park and trail purposes; and WHEREAS,the City,as a municipality located within Larimer County,receives a monthly distribution from the County for its share of the aforementioned County sales and use tax; and WHEREAS,the City's portion of the tax proceeds are deposited in the Open Lands Fund to be used to further implement the Fort Collins Natural Areas Plan; and WHEREAS,the proposed use of the Open Land Fund for the Project is consistent with the City's Natural Areas Plan; and WHEREAS, the funds totaling $200,000 were identified as part of the 1997 budget and set aside for the Project; and WHEREAS,the use of Conservation Trust Fund monies for the Project are consistent with purposes as identified in C.R.S. 29-21-101; and WHEREAS, the Colorado Department of Transportation has made available to the City, Intermodal Surface Transportation Enhancement Act (ISTEA) funds in the amount of$144,000 to be used for the Project; and WHEREAS, the federal grant funds require a local match of $36,000 and this match is provided as part of the $200,000 from General Fund prior year reserves; and WHEREAS,Article V, Section 9 of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years notwithstanding that such reserves were not previously appropriated; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins also permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10, of the Charter of the City of Fort Collins authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the proposed transfer is from a capital project in which the amount appropriated exceeds the amount needed to accomplish the purpose specified in the appropriation ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from prior year reserves in the General Fund the sum of TWO HUNDRED THOUSAND DOLLARS ($200,000) for transfer to the Capital Projects Fund, Gateway Park capital project and appropriated therein. Section 2. That there is hereby appropriated for expenditure from unanticipated grant revenue in the Capital Projects Fund the sum of ONE HUNDRED FORTY-FOUR THOUSAND DOLLARS ($144,000) for the Gateway Park capital project. Section 3. That the unexpended appropriated amount of TWO HUNDRED TEN THOUSAND DOLLARS ($210,000)is hereby authorized for transfer from the Open Lands Fund, to the Capital Projects Fund, Gateway Park capital project and appropriated therein. Section 4. That the unexpended appropriated amount of ONE HUNDRED TEN THOUSAND DOLLARS ($110,000)is hereby authorized for transfer from the Conservation Trust Fund, Other Open Space capital project to the Capital Projects Fund, Gateway Park capital project and appropriated therein.
