OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 2, ARTICLE II, DIVISION 3 OF THE
CITY CODE PERTAINING TO THE PROCEDURE FOR HEARING
APPEALS TO THE CITY COUNCIL
WHEREAS, Chapter 2, Article II, Division 3 of the Code of the City of Fort Collins (the
"Code") establishes a procedure for hearing appeals taken to the City Council from the decisions of
certain boards and commissions of the City; and
WHEREAS, said appeals procedure specifically lists the boards and commissions from
which appeals may be taken to the City Council, including the City's Planning and Zoning Board;
and
WHEREAS, the City of Fort Collins "Land Use Code" (the "Land Use Code"), as adopted
by the Council of the City of Fort Collins pursuant to Ordinance No. 51, 1997, establishes certain
rights of appeal to the City Council from decisions of the Director of Community Planning and
Environmental Services(the"Director"),as well as decisions of the Planning and Zoning Board;and
WHEREAS, both the Planning and Zoning Board and the Director are referenced in the
"Land Use Code" as the "decision maker"; and
WHEREAS, the Council has determined that the appeals procedures as established in
Chapter 2,Article II, Division 3 of the Code should be amended to include the "decision maker" as
established in the "Land Use Code."
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That Section 2-47(4) of the Code is hereby amended to read as follows:
Sec. 2-47. Certain appeals to be taken to City Council.
Appeals taken from decisions made by any of the following boards, commissions,
or other decision makers, shall be taken to the City Council in the manner set forth
in this Division:
(1) Building Review Board;
(2) Fire Board of Appeals;
(3) Landmark Preservation Commission;
(4) Planning and Zoning Board;
(5) A "decision maker" under the provisions of Section 2.2.12 of the Land Use
Code;
(6) Water Utilities Board;
(7) Zoning Board of Appeals.
Section 2. That throughout Chapter 2, Article II, Division 3 of the Code, wherever the words
"board or commission" are used, such words should be followed by the words "or other decision
maker," and Chapter 2, Article II, Division 3 is hereby amended to that effect.
