HomeMy WebLinkAbout048 - 03/18/1997 - AMENDING CITY CODE RELATING TO MUNICIPAL ELECTIONS (TO REMOVE REFERENCES TO THE CAMPAIGN REFORM ACT) ORDINANCE NO. 48, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 7, ARTICLE IV, DIVISION 2 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO MUNICIPAL ELECTIONS WHEREAS, the conduct of municipal elections is governed by State Statute and the Code of the City of Fort Collins; and WHEREAS, at the November 5, 1996 general election, the voters of the state of Colorado approved Amendment 15, which repealed and reenacted Article 45 of Title 1, Colorado Revised Statutes, otherwise known as the "Campaign Reform Act"; and WHEREAS, Article 45 of Title 1, Colorado Revised Statutes was reenacted as the "Fair Campaign Practices Act"; and WHEREAS, Chapter 7,Article IV,Division 2 of the Code of the City of Fort Collins,which contains references to the"Campaign Reform Act,"should be amended to remove references to the "Campaign Reform Act." NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Sections 7-126, 7-128,and 7-129 of the Code of the City of Fort Collins are hereby amended to read as follows: Sec. 7-126. Definitions. The terms and phrases contained in this Article shall be deemed to have the same meanings as ascribed to such terms and phrases in Section 1-45-103 of the Colorado Revised Statutes, except as otherwise provided herein. Sec. 7-128. Campaign reports to be filed with City Clerk. Campaign treasurers for candidates for municipal elections and campaign treasurers for issues shall file with the City Clerk any campaign reports or information required to be filed pursuant to this Article and Article 45 of Title 1, Colorado Revised Statutes. Sec. 7-129. Additional preelection report required. In addition to the reports required to be filed pursuant to the provisions of C.R.S. 1-45-101 et seq., each candidate and campaign treasurer for candidates or issues shall, before 9:00 a.m. on the Thursday prior to the date of the election, file a campaign report, current in all respects, as of two (2) days prior to the filing date, which report shall include all required information in C.R.S. 1-45-108. All other campaign reports shall be filed with the City Clerk before 9:00 a.m. on the date due.
