APPROPRIATING STORM DRAINAGE F'
PRIOR YEAR RESERVES INTO THE
MCCLELLAND/MAIL CREEK BASIN '
CAPITAL IMPROVEMENTS
WHEREAS, storm drainage fees are collected in the McClelland/Mail Creek Basin to fund
the construction of master plan basin improvements as well as minor capital improvements; and
WHEREAS, the Stormwater Utility has identified the installation of a regional detention
facility("Mountain Ridge Detention Pond")as a capital improvement in the McClelland/Mail Creek
Master Plan; and
WHEREAS, Miramont Associates LLC (the"Developer")has approved development plans
to construct a residential subdivision in the same area; and
WHEREAS,joint construction of the subdivision and the Mountain Ridge Detention Pond
will minimize future impacts to the public and provide cost savings to the City and the Developer;
and
WHEREAS, Section 26-545 of the Code of the City of Fort Collins allows the City to
reimburse a developer for constructing major stormwater system improvements that serve more than
that development; and
WHEREAS, Article V, Section 5 of the Charter of the City of Fort Collins (the "Charter")
required that capital projects be itemized in the budget by individual project; and
WHEREAS, the individual basins in the City are treated as capital projects; and
WHEREAS, the result of such itemization is that each individual basin in the budget is
treated as a separate fund; and
WHEREAS,Article V, Section 8 of the Charter authorizes the City to provide by ordinance
for payment of any expense from reserves accumulated in prior years, notwithstanding that such
reserves were not appropriated for expenditures in the annual appropriation ordinance; and
WHEREAS, funds to cover these expenditures are available from prior year reserves in the
Storm Drainage fund.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated from prior year reserves in the Storm Drainage fund the
sum of THREE HUNDRED THOUSAND DOLLARS ($300,000) for transfer to and expenditure
in the McClelland/Mail Creek Basin to construct the Mountain Ridge Detention Pond.
