HomeMy WebLinkAbout042 - 03/04/1997 - VACATING RIGHT-OF-WAY FOR FALCON HILL ROAD ORDINANCE NO. 42, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE RIGHT-OF-WAY FOR FALCON HILL ROAD AS DEDICATED ON THE FALCON RIDGE PUD PLAT WHEREAS,the plat for Falcon Ridge PUD dedicated to the public a right-of-way for Falcon Hill Road which included dedication of a right-of-way for a cul-de-sac; and WHEREAS, the Planning and Zoning Board has approved a project entitled "Fire Station 412 @ Falcon Ridge PUD" ("the Fire Station PUD") which replats Lots 14 thru 19 and Tract B of the Falcon Ridge PUD, which abut said right-of-way for Falcon Hill Road; and WHEREAS, the approval of the Fire Station PUD requires the vacation of certain portions of the original right-of-way dedicated for Falcon Hill Road more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, said portion of the Falcon Hill Road right-of-way is no longer needed for cul- de-sac purposes due to the replatting of the lots and the platting of new cul-de-sac right-of-way associated with the Fire Station PUD; and WHEREAS, pertinent City agencies and private utility companies have been contacted and have reported no objection to the proposed vacation; and WHEREAS, the rights of the citizens of the City of Fort Collins will not be prejudiced or injured by the vacation of said right-of-way. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portion of the right-of-way for Falcon Hill Road, more particularly described on Exhibit"A" attached hereto is hereby vacated, abated and abolished. Introduced, considered favorably on First Reading, and ordered published this 18th day of February A.D. 1997, and to be presented for final passage o t day of Ma D. 1997 May or ATTEST: City Clerk Passed and adopted on final reading this 4th day of March,A.D. 1997. `�ayor ATTEST: City Clerk EXHIBIT A PROPERTY DESCRIPTION Falcon Ridge Road- Street Vacation A parcel of land being part of the platted and dedicated Falcon Hill Road as contained within A Plat Of Falcon Ridge P.U.D., City of Fort Collins, County of Larimer, State of Colorado and being part of the Southwest Quarter(S W I/4) of Section Thirty-six (36),Township Eight North (T.8N.), Range Sixty-nine West(R.69W.) of the Sixth Principal Meridian (6th P.M.), and being more particularly described as follows: BEGINNING at the Northwest Comer(NW Cor) of Lot 13 of said A Plat Of Falcon Ridge P.U.D. and considering the West line of said Lot 13 to bear North 00°35'00" West, as platted, with all other bearings contained herein relative thereto: THENCE North 00035'00" West a distance of 16.96 feet to a Point of Curvature (PC). Said point being the TRUE POINT OF BEGINNING: THENCE along the Arc of a curve which is concave to the Southwest a distance of 91.91 feet, whose Radius is 44.00 feet, whose Delta is 119°40'45", and whose Long Chord bears North 60° 25'22" West a distance of 76.09 feet to a point on a non-tangent curve; THENCE along the Arc of a curve which is concave to the South a distance of 188.81 feet, whose Radius is 44.00 feet, whose Delta is 245°02'43", and whose Long Chord bears South 86' 14'10" East a distance of 74.20 feet to a Point of Reverse Curvature(PRC); THENCE along the Arc of a curve which is concave to the East a distance of 26.38 feet, whose Radius is 41.00 feet, whose Delta is 36'52'12", and whose Long Chord bears South 17°5F06" West a distance of 25.91 feet to the Point of Tangency (PT); THENCE South 00°35'00" East a distance of 8.00 feet to the TRUE POINT OF BEGINNING.
