HomeMy WebLinkAbout119 - 07/21/1998 - APPROPRIATING UNANTICPATED REVENUE AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE STORM ORDINANCE NO. 119, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE STORM DRAINAGE FUND THE GENERAL FUND AND THE FLOOD MITIGATION FUND WHEREAS,on July 28 and 29, 1997, a flash flood hit Fort Collins, causing severe damage to certain areas of the City and resulting in the loss of five lives and injuries to 54 people; and WHEREAS,the flood destroyed 120 mobile homes and damaged vehicles,severely damaged public and private infrastructure, caused the evacuation of residences and businesses, caused the temporary closure of businesses, and caused the loss or destruction of various items of personal property; and WHEREAS,on August 1, 1997,President Clinton declared Larimer County a federal disaster area thereby qualifying the City for various types of disaster assistance programs, including assistance from the Federal Emergency Management Agency (FEMA), the Small Business Administration (SBA), and the Department of Housing and Urban Development(HUD); and WHEREAS,to date,the City is receiving disaster recovery funds from FEMA and emergency relief funds from the Federal Highway Administration, and has been approved to receive Disaster Recovery Initiative Funds from HUD; and WHEREAS,on May 28, 1998,the State Office of Emergency Management announced that the City would receive$411,667 of Hazard Mitigation Grant Funds approved by FEMA,providing funds for the City to implement a Floodproofing Program and a Flood Warning Program; and WHEREAS,the purpose of a developing a Floodproofing Program will be to utilize grants to encourage the construction of cost-effective floodproofing measures in an effort to mitigate repetitive losses from shallow flooding; and WHEREAS, the estimated cost to develop a Floodproofing Program is $204,000; and WHEREAS,staff has identified the following sources to fund the aforementioned program: Federal Hazard Mitigation Grant Funds (including a federal administrative cost allowance of$4,000) $ 154,000 Local matching funds from existing appropriations in the Storm Drainage Fund 50,000 Total $ 204,000 and WHEREAS, developing a Flood Warning Program would entail the installation of streamflow and precipitation monitoring equipment to provide maximum warning time in the event of a flooding emergency; and WHEREAS,the estimated cost to develop a Flood Warning Program is $341,000; and WHEREAS,staff has identified the following sources to fund the aforementioned program: Federal Hazard Mitigation Grant Fund (including a federal administrative allowance of$7,667) $ 257,667 Local matching funds from existing appropriations in the Storm Drainage Fund 41,667 Local matching funds from existing appropriations in the General Fund 41,666 Total $ 341,000 and WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins(the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in conjunction with all previous appropriations for that fiscal year, do not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from Hazard Mitigation Grant Funds in the Flood Mitigation Fund,Floodproofing Project,the sum of ONE HUNDRED FIFTY- FOUR THOUSAND DOLLARS ($154,000) upon receipt from the Office of Emergency Management to be used to develop a Floodproofing Program. Section 2. That the unexpended appropriated amount of FIFTY THOUSAND DOLLARS ($50,000) is hereby authorized for transfer from the Storm Drainage Fund to the Flood Mitigation Fund, Floodproofing Project, and appropriated therein to develop a Floodproofing Program. Section 3. That there is hereby appropriated for expenditure from Hazard Mitigation Grant Funds in the Flood Mitigation Fund,Flood Warning Project,the sum of TWO HUNDRED FIFTY- SEVEN THOUSAND SIX HUNDRED SIXTY-SEVEN DOLLARS($257,667)upon receipt from the Office of Emergency Management to be used to develop a Flood Warning Program. Section 4. That the unexpended appropriated amount of FORTY-ONE THOUSAND SIX HUNDRED SIXTY-SIX DOLLARS ($41,666) is hereby authorized for transfer from the General Fund to the Flood Mitigation, Flood Warning Project, and appropriated therein to develop a Flood Warning Program. Section 5. That the unexpended appropriated amount of FORTY-ONE THOUSAND SIX HUNDRED SIXTY-SEVEN DOLLARS($41,667)is hereby authorized for transfer from the Storm Drainage Fund to the Flood Mitigation Fund, Flood Warning Project, and appropriated therein to develop a Flood Warning Program.
