HomeMy WebLinkAbout117 - 07/07/1998 - AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE LIBRARY DEPARTMENT IN THE GENERAL FUND AND TH ORDINANCE NO. 117, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE LIBRARY DEPARTMENT IN THE GENERAL FUND AND THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND AND APPROVING THE COMMISSION OF "FOREST LIGHT" WHEREAS, the City Council adopted Ordinance No. 160, 1995, on January 6, 1996, appropriating $1,700,000 from the Sales and Use Tax Fund Use Tax Carryover Reserve and authorizing the transfer of said appropriation to the Library Department in the General Fund to be used to construct and open a community library (the "Harmony Library"); and WHEREAS, pursuant to Section 23-304 of the City Code, one percent (1%) of the construction cost appropriated for the Harmony Library was to be set aside in the Art in Public Places reserve account in the Cultural Services and Facilities Fund, for use in the acquisition or leasing of works of art, maintenance, repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council in Ordinance No. 47, 1998 (the "Guidelines"); and WHEREAS,one percent(1%)of the funds appropriated for the construction of the Harmony Library in Ordinance No. 160, 1995, or$14,150, representing the City's share, was not previously transferred to the Art in Public Places reserve account in the Cultural Services and Facilities Fund; and WHEREAS, Article V, Section 10, of the Charter of the City of Fort Collins authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff, the Art in Public Places Board, Front Range Community College staff,students,project designers,and state legislative representatives(the"Design Committee")have reviewed proposals for public art in connection with the Harmony Library; and WHEREAS, the Design Committee selected George Peters to create a sculpture for the Harmony Library entitled "Forest Light", and the Art in Public Places Board reviewed and recommended approval of that selection at its May 21. 1998, meeting; and WHEREAS, the City's share of$14,150 will be combined with funds from the State's Art in Public Places Program, totaling $16,904, for a total of$31,054, which will be available for the George Peters sculpture at the Harmony Library; and WHEREAS, City Code Section 23-308 requires that the Council approve the use of reserve account funds in excess of$10,000 for the acquisition,installation and maintenance of works of art; and WHEREAS, it is the desire of the Council to authorize the transfer of$14,150 from the Library Department in the General Fund to the Art in Public Places reserve account in the Cultural Services and Facilities Fund, to be used with State funds for the sculpture "Forest Light" for the entryway of the Harmony Library, as proposed by George Peters. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the unexpended appropriated amount of FOURTEEN THOUSAND ONE HUNDRED FIFTY DOLLARS ($14,150) is hereby authorized for transfer from the Library Department in the General Fund to the Art in Public Places reserve account in the Cultural Services and Facilities Fund, and appropriated therein, to be used for the commission of a sculpture project for the Harmony Library. Section 2. That the expenditure of up to FOURTEEN THOUSAND ONE HUNDRED FIFTY DOLLARS ($14,150)from the Art in Public Places reserve account in the Cultural Services and Facilities Fund, to be used for the commission of artist George Peters for the creation of the sculpture"Forest Light"for installation in the entryway of the Harmony Library,as approved by the Art in Public Places Board on May 21, 1998, is hereby authorized. Introduced and considered favorably on first reading and ordered published this 16th day of June, A.D. 1998, and to be presented for final passage on the 7th day of July, A.D. 1998.
