OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING STORM DRAINAGE FUND
PRIOR YEAR RESERVES INTO THE CANAL IMPORTATION BASIN
FOR THE ACQUISITION OF RIGHT-OF-WAY AND DESIGN OF
CAPITAL IMPROVEMENTS
WHEREAS, storm drainage fees are collected in the Canal Importation Basin to fund the
construction of drainage basin master plan improvements as well as minor capital improvements;
and
WHEREAS, the Canal Importation Drainage Basin Master Plan includes the installation of
channels and detention ponds to capture and control storm runoff generated in the basin and
recommends capital improvements in the Canal Importation Basin; and
WHEREAS,a regional detention pond located west of Overland Trail was included in the Canal
Importation Drainage Basin Master Plan; and
WHEREAS,the City wishes to perform design on the regional detention pond and the drainage
facilities identified in the master plan; and
WHEREAS, the City also wishes to acquire eight lots for the potential expansion of a local
detention pond in the Fairbrooke Heights P.U.D. in order to allow flexibility in continued
discussions with adjacent property owners regarding the final design of storm drainage
improvements in that area; and
WHEREAS,the additional right-of-way provided by the acquisition of the above referenced lots
will also allow a more flexible master plan update and cost effective design of the facilities; and
WHEREAS, if it determined that the right-of-way is not needed in the future, the City of Fort
Collins would have the option to sell the right-of-way; and
WHEREAS, funds to cover these expenditures are available in the Storm Drainage Fund prior
year reserves; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the City
Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as
may be available from reserves accumulated in prior years,notwithstanding that such reserves were
not previously appropriated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from prior year reserves in the Storm
Drainage Fund the sum of FOUR HUNDRED TWENTY FIVE THOUSAND DOLLARS
($425,000) for the Canal Importation Basin capital projects and to allow the City Manager to
acquire right-of-way for storm drainage facilities.

A.D. 1998, and to be presented for final passage on the 7th day of July, A.D. 1998.
