OF THE COUNCIL OF THE CITY OF FORT COLLINS
SUSPENDING THE DEVELOPMENT IMPACT FEE REBATE PROGRAM
FOR AN INDEFINITE PERIOD
WHEREAS, the City Council established by Ordinance No. 44, 1990, a program for the
rebate of impact fees for economic development, codified at Sections 5-325 through 5-329 of the
Code of the City of Fort Collins (the"Development Fee Rebate Program"); and
WHEREAS, the Development Fee Rebate Program, as modified by the adoption of
Ordinance No. 123, 1994, has continued in place to date, and
WHEREAS, it is the City Council's desire to review and evaluate the City's incentive
programs for economic development, including the Development Fee Rebate Program, along with
other components of the City's Economic Policy, with a concern for tax and fee fairness and
effectiveness of economic development incentive policies and programs; and
WHEREAS, it is further the Council's desire to indefinitely suspend the operation of the
Development Fee Rebate Program, pending completion of such review and evaluation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City's program for Rebate of Impact Fees for Economic Development,
codified at Sections 5-325 through 5-329 of the Code of the City of Fort Collins(the"Development
Fee Rebate Program"),is hereby suspended from operation until such time,if at all,that the Council
reinstates the same by the adoption of an ordinance for that express purpose.
Section 2. That no further Development Fee Rebates shall be granted by the City Council
unless (1) a letter of intent to request a Development Fee Rebate was received by the City prior to
the adoption of this Ordinance on first reading,(2)all information required for determination of such
rebate is received by the City prior to October 1, 1998, and (3) the City Council finds that such
application meets the criteria for approval of the same under Section 5-327 of the City Code.
