HomeMy WebLinkAbout065 - 05/06/1997 - APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND FOR RESTORATION/IMPROVEMENTS TO THE ORDINANCE NO. 65, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND FOR RESTORATION WORK AND IMPROVEMENTS TO THE OLD COLORADO AND SOUTHERN FREIGHT DEPOT AND ANNIE'S GRAVE SITE LOCATED AT 136 WEST LAPORTE AVENUE WHEREAS,the City Council passed Resolution 94-211,on December 20, 1994,authorizing the City to enter into an agreement with Trillium Corporation to purchase the Old Colorado and Southern Railroad Freight Depot (the "Old Depot") located at 136 West LaPorte Avenue; and WHEREAS, the Old Depot was purchased by the Stormwater Utility with the intent to restore the building and to utilize a portion of the building for office space for the City's Stormwater Department and use the remaining space for expansion of other City facilities; and WHEREAS, the Old Depot and the grave site and a memorial headstone dedicated to "Annie," a mixed breed dog that was the mascot for the Colorado and Southern Freight Depot from 1934 to 1948 were recognized by the Landmark Preservation Commission and staff as significant in terms of their contribution to the history of transportation in Fort Collins; and WHEREAS, on August 1, 1995, City Council adopted Ordinance No. 93, 1995, designating the Old Depot as a historic landmark, as recommended by the Landmark Preservation Committee; and WHEREAS, on November 21, 1995, City Council adopted Ordinance No. 140, 1995, designating Annie's grave site and memorial headstone at 136 West LaPorte Avenue as a historic landmark, as recommended by the Landmark Preservation Committee; and WHEREAS, the City applied for a grant from the State of Colorado for the receipt of Historical Society funds to be used along with existing appropriations within the Capital Projects Fund to renovate the Old Depot and Annie's grave site; and WHEREAS, on May 14, 1996,the Colorado Historical Society awarded the City a grant for $100,000 to be used for historical renovation work on the Old Depot and Annie's grave site; and WHEREAS, subsequent to the City being awarded the grant, City staff decided that the Stormwater Utility would relocate to the Utility Service Center at 700 Wood Street, rather than use the Old Depot for future office space; and WHEREAS, the scope of work to be done at the Old Depot and Annie's grave site subsequently changed due to the aforementioned decision regarding Stormwater office space; and WHEREAS, while the scope of the project changed, the City is committed to completing certain repairs to the Old Depot and Annie's grave site in order to protect the building from further deterioration; and WHEREAS, staff provided the Colorado Historical Society with a revised project scope for the Old Depot and Annie's grave site, which was approved by the State at a revised award of $97,000; and WHEREAS,local matching funds needed for restoration and improvements to the Old Depot and Annie's grave site have been identified and are appropriated in the Capital Projects Fund; and WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins (the "Charter") authorizes the City Council to appropriate unanticipated revenues which are the result of new revenue sources at any time during the year in which such revenue is received; and WHEREAS, it is the desire of the Council to appropriate the sum of$97,000 in State of Colorado Historical Society Funds to be used with existing appropriations in the Capital Projects Fund for the purpose of restoring and protecting the Old Depot and Annie's grave site. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund,Facilities Master Plan/Land Acquisition capital project,the sum of NINETY- SEVEN THOUSAND DOLLARS ($97,000) from the State of Colorado Historical Society to be used to restore and improve portions of the building and Annie's grave site located at 136 West LaPorte Avenue.
