HomeMy WebLinkAbout031 - 04/05/1988 - AMENDING CITY CODE RELATING TO THE MODEL TRAFFIC CODE, 1977 EDITION ORDINANCE NO. 31, 1988 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 28-17 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES, 1977 EDITION BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 28-17 of the Code of the City of Fort Collins is hereby amended as follows: Section 1 . That Subsections (26) (a) through (c) , amending Section 22-20 of the Model Traffic Code entitled "Authority to impound or immobilize vehicles, prohibited acts, " are amended to read as follows: (a) Definitions. As used in this section: (1) Abandoned vehicle means: a. Any vehicle left unattended on private property for a period of twenty-four (24) hours or longer without the consent of the owner or lessee of such property or his or her legally authorized agent; or b. Any vehicle left unattended on public property, including any portion of a street or highway right-of-way, within the municipality for a period of twenty-four (24) hours or longer unless the owner or driver has conspicuously affixed thereto a dated notice indicating his or her intention to return or has otherwise notified the appropriate law enforcement agency of his or her intention to remove the same within seventy-two (72) hours. (b) No person shall abandon any vehicle upon public property or upon private property other than his or her own. Abandoned vehicles may be towed and impounded in accordance with the provisions of Title 42, Article 4, Part 16, C.R.S. (c) Whenever any police officer finds a vehicle, attended or unattended, standing upon any portion of a street or highway right-of-way within this municipality in such a manner as to constitute a violation of section 10-5 of this code, such officer is authorized to cause the vehicle to be moved to eliminate any such obstruction or to tow and impound the vehicle in accordance with the provisions of Title 42, Article 4, Part 16. C.R.S. Section 2. That Subsection (27) , amending Section 22-21 of the Model Traffic Code, entitled "Disposal of abandoned vehicle, " is amended to read as follows: (27) Section 22-21 , Disposal of abandoned vehicle, is amended to read as follows: Section 22-21 . Storage and disposal of abandoned and illegally parked vehicles. - Vehicles removed from public or private property within this municipality and placed in storage as provided in section 22-20 of this code shall be stored and disposed of in accordance with the provisions of Title 42, Article 4, Part 16, C.R.S.
