HomeMy WebLinkAbout073 - 04/18/1989 - AMENDING CITY CODE RELATING TO CERTAIN DEFINITIONS IN CHAPTER 29 AND TO SETBACKS FOR GROUND SIGNS ORDINANCE NO. 73, 1989 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 29 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO CERTAIN DEFINITIONS IN CHAPTER 29 AND TO SETBACKS FOR GROUND SIGNS WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interest of the City to reduce litter, increase the recycling of reusable material and conserve natural resources; and WHEREAS, the Council has determined that it is in the City's best interest to measure the setbacks for ground signs by establishing a sight distance triangle to ensure the safety of vehicular and pedestrian traffic. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Section 29-1 of the Code of the City of Fort Collins is hereby amended as follows: follows: A. The definition of Junkyard is hereby amended to read as Junkyard shall mean an industrial use (not permitted in residential , business or commercial districts) contained within a building, structure or parcel of land, or portion thereof, used for the collecting, storage or sale of wastepaper, rags, scrap metal or discarded material or for the collecting, dismanteling, storage, salvaging or demolition of vehicles, machinery or other material and including the sale thereof, in whole or in part. A junkyard shall not mean a recycling facility. B. The following definitions are hereby added, to be inserted alphabetically and to read as follows: Recyclable material shall mean reusable material , including but not limited to metals, glass, plastic and paper, which are intended for reuse or reconstitution for the purpose of using the altered form. Recyclable material does not include refuse or hazardous materials. Recycling facility shall mean a building used for the collection and/or processing of recyclable material . Processing means the preparation of material for efficient shipment by such means as baling, compacting, flattening, grinding, crushing, mechanical sorting, and cleaning. Such a facility, if entirely enclosed within a building or buildings, shall be considered a warehouse. Section 2. That Section 29-595(a) of the Code of the City of Fort Collins is hereby repealed in its entirety and reenacted to read as follows: (a) Ground signs which exceed forty-two (42) inches in height, and freestanding signs which do not maintain free air space between a height of forty-two (42) inches and seventy-two (72) inches above the adjacent street elevation, shall be set back from the right-of-way line a distance as established in the sight distance triangle table contained in this subsection. A freestanding sign shall not be construed to have free air space if such sign has a base, the width of which exceeds fifty (50) percent of the width of its face or three (3) feet, whichever is smaller. In addition, freestanding signs shall not be located closer to the right-of-way line than allowed in subparagraph (c) of this section. For explanation of distances, see the diagram below. These distances are typical sight distance triangles to be used under normal conditions and may be modified by the Director of Engineering in order to protect the public safety and welfare in the event that exceptional site conditions necessitate such modification.
