HomeMy WebLinkAbout150 - 12/07/1993 - DESIGNATING THE CUNNINGHAM CORNER BARN AS A HISTORIC LANDMARK ORDINANCE NO. 150, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS DESIGNATING THE CUNNINGHAM CORNER BARN AS A HISTORIC LANDMARK PURSUANT TO CHAPTER 14 OF THE CODE OF THE CITY OF FORT COLLINS WHEREAS, pursuant to Section 14-2 of the City Code, the City Council has established a public policy encouraging the protection, enhancement and perpetuation of historic landmarks within the City; and WHEREAS, by Resolution dated November 3, 1993, the Landmark Preservation Commission ("Commission") has determined that the barn at the NE corner of South Shields and West Horsetooth has architectural and historical importance to the City due to its architectural and historical significance to the community; and WHEREAS, the Commission has further determined that said structure meets the criteria of a landmark as set forth in Section 14-5 of the Code and is eligible for designation as a local landmark, and has recommended to the City Council that said structure be designated by the City Council as a local landmark; and WHEREAS, the owner of the property has consented to such landmark designation; and WHEREAS, such landmark designation will preserve the property's significance to the community; and WHEREAS, the City Council has reviewed the recommendation of the Commission and desires to approve such recommendation and designate said property as a historic landmark. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the structure located on lands in the City of Fort Collins, Larimer County, Colorado, described as follows, to wit: A portion of the Southwest Quarter of Section 26, Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado being described as follows: BEGINNING at the South west corner of the Southwest Quarter of said Section 26, and considering the Westerly line of said Southwest Quarter to bear North 00 degrees 27 minutes 27 seconds West with all bearings contained herein relative thereto: thence North along said Westerly line North 00 degrees 27 minutes 27 seconds West, 64.81 feet; thence departing said Westerly line North 89 degrees 32 minutes 33 seconds East, 50.00 feet to the Easterly right of way line of Shields Street and the TRUE POINT OF BEGINNING of this description; thence North along said Easterly line North 00 degrees 27 minutes 27 seconds West, 387. 19 feet; thence North 00 degrees 27 minutes 27 seconds West, 23.25 feet; thence North 89 degrees 32 minutes 33 seconds East, 128.32 feet; thence along a curve to the left having a delta of 44 degrees 54 minutes 20 seconds, a radius of 309.00 feet, an arc of 242.18 feet and a long chord which bears North 67 degrees 05 minutes 23 seconds East 236.03 feet; thence south 45 degrees 21 minutes 47 seconds East, 244.21 feet; thence South 44 degrees 38 minutes 13 seconds West, 223.02 feet; thence South 00 degrees 17 minutes 16 seconds East, 186.70 feet to the North right of way line of Horsetooth Road; thence Westerly along said Northerly line South 89 degrees 42 minutes 44 seconds West, 513.19 feet; thence along a curve to the right having a delta of 89 degrees 49 minutes 49 seconds, a radius of 15 feet, an arc of 23.52 feet and a long chord which bears North 45 degrees 22 minutes 22 seconds West, 21.18 feet to the POINT OF BEGINNING of this description. EXCEPT any portion contained in Plat of 7-Eleven Convenience Store, a Planned Unit Development, at Cunningham Corner recorded January 13, 1986 as Reception No. 86002162. be, and hereby is, designated as a historic landmark pursuant to Chapter 14 of the Code of the City of Fort Collins. Section 2. That in the event that the Cunningham Corner Barn should be relocated from that property as described in Section 1 hereof to that parcel of property as described on Exhibit "A" attached hereto and incorporated herein by this reference, then the designation established pursuant to this Ordinance shall apply to that property as described on Exhibit "A," and upon such relocation, the designation established pursuant to this Ordinance shall terminate and become null and void as it applies to that property as described in Section 1 hereof. Section 3. That the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings (U.S. Department of the Interior, National Park Service, Revised 1983) shall serve as the standards by which alterations, additions and other changes to the structure located upon the above described property shall be reviewed for compliance with Chapter 14, Article III, of the Code of the City of Fort Collins.
