OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE
MASON/HOWES CAPITAL PROJECT TO THE "NORTH COLLEGE AVENUE
ENHANCEMENT CAPITAL PROJECT" AND AUTHORIZING THE CITY MANAGER
TO ENTER INTO A CONTRACT WITH THE STATE OF COLORADO FOR THE
ENHANCEMENT ITEMS FOR THE NEW STATE HIGHWAY BRIDGE OVER
THE POUDRE RIVER ON NORTH COLLEGE AVENUE
WHEREAS, the City expects Intermodal Surface Transportation Efficiency Act
(ISTEA) funds from the State of Colorado in the amount of $123,000 will be used
by the State for the replacement of the North College Avenue bridge over the
Poudre River and for bridge enhancement work ("the Project") ; and
WHEREAS, the ISTEA money represents 82% of the Project's cost and requires
the City to provide 18% of matching funds for the Project, equal to the amount
of $28,000; and
WHEREAS, $28,000 is available in the Mason/Howes Phase II Capital Project
to provide these matching funds because said funds are no longer needed for the
Mason/Howes Phase II Capital Project; and
WHEREAS, Article V, Section 14, of the City Charter provides that the
Council may, by ordinance, upon the recommendation of the City Manager, transfer
any unexpended appropriated amount or portion thereof from one fund to another,
provided that the purpose for which the transferred funds are to be expended
remains unchanged or the purpose for which the funds were initially appropriated
no longer exists; and
WHEREAS, the City Manager is recommending the transfer of $28,000 from the
Mason/Howes Phase II Capital Project to the North College Avenue Enhancement
Capital Project within the Capital Projects Fund; and
WHEREAS, in order for the $123,000 in ISTEA funds from the State of
Colorado to be expended on the Project, the City must enter into an agreement
with the State concerning such funds.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the amount of Twenty-eight Thousand Dollars ($28,000) in
the Mason/Howes Phase II Capital Project is hereby authorized for transfer to the
North College Avenue Enhancement Capital Project to be used for the Project.
Section 2. That the Mayor is hereby authorized to enter into an Agreement
with the State of Colorado, on behalf of the City of Fort Collins, to allow the
State to expend up to One Hundred Twenty-three Thousand Dollars ($123,000) in
ISTEA funds on the Project and to require the City to expend up to Twenty-eight
Thousand Dollars ($28,000) in matching funds on the Project.
Introduced, considered favorably on first reading, and ordered published
this 16th day of November, A.D. 1993, and to be presented for final passage on
the 7th day of December, A.D. 1993.
