HomeMy WebLinkAbout140 - 11/02/1993 - AUTHORIZING TRANSFER OF FUNDS FROM GENERAL INTO PARKLAND FUND TO ASSIST IN PAYMENT OF PARKLAND FEES ORDINANCE NO. 140, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF FUNDS FROM THE THE GENERAL FUND INTO THE PARKLAND FUND FOR THE PURPOSE OF ASSISTING IN THE PAYMENT OF PARKLAND FEES FOR FY 1992 COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS WHICH INVOLVE THE PAYMENT OF PARKLAND FEES WHEREAS, on June 2, 1993, the Council of the City of Fort Collins adopted the FY 1992 Community Development Block Grant (CDBG) Program and authorized the funding of projects thereunder; and WHEREAS, certain of said projects involve the payment to the City of parkland fees; and WHEREAS, CDBG recipients for projects funded through the FY 1992 CDBG Program budgeted their projects for payment of the City's parkland fee on the basis of the fee in effect at the time of Program approval ; and WHEREAS, all Fiscal Year 1992 CDBG contingency funds have been reprogrammed into the Fiscal Year 1993 CDBG Program and are unavailable for supplemental funding for Fiscal Year 1992 CDBG projects; and WHEREAS, on July 20, 1993, the City Council passed, on second reading, Ordinance No. 82, 1993, establishing an increase in the City's parkland fee of $154.00 per unit; and WHEREAS, the Council believes that said increment of increase in the City's parkland fee should not be collected from CDBG projects which are funded with FY 1992 funds if such projects were established and budgeted based upon the parkland fee in existence prior to the adoption of Ordinance No. 82, 1993; and WHEREAS, two FY 1992 CDBG projects (the Community Affordable Residences Enterprises and the Resource Assistance Center) have requested assistance from the City in the payment of the aforesaid increment of increase in parkland fees, which assistance, in the aggregate, totals $4,774; and WHEREAS, the Council has determined that the provision of said assistance would serve a valid public purpose; and WHEREAS, the Council further determines that said increment of increase should be paid into the Parkland Fund by transfer from the General Fund; and WHEREAS, Article V, Section 14, of the Charter authorizes the City Council to transfer by ordinance any unexpended appropriated amounts or portion thereof from one fund to another upon the recommendation of the City Manager, provided that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the parkland fee that shall be collected from any CDBG project funded with FY 1992 funds which involves the payment of Parkland fees to the City, and which was budgeted based upon the City's established parkland fee prior to the enactment of Ordinance No. 82, 1993, shall be that parkland fee which existed immediately prior to the enactment of said Ordinance No. 82, 1993. Section 2. That said increment of increase shall be paid into the Parkland Fund by transfer from the General Fund. Section 3. That the unexpended appropriated amount of Four Thousand Seven Hundred Seventy-four Dollars ($4,774) is hereby authorized for transfer from the General Fund to the Parkland Fund.
