HomeMy WebLinkAbout136 - 11/16/1993 - AMENDING CITY CODE RELATING TO RATES FOR WATER AND WASTEWATER UTILITY ORDINANCE NO. 136, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO RATES FOR THE WATER AND WASTEWATER UTILITY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS: Section 1. That Section 26-279, subparagraphs (a) and (c) (1) and (2) , of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-279. Service charges; categories. (a) Monthly service charges for wastewater utility service are determined by category as hereinafter provided. Nonresidential users are also subject to a monthly surcharge according to the strength and quantity of wastewater discharged into the wastewater system as provided in § 26-281. (c) The rate determination by category is as follows: (1) The rate for categories A and B shall be a flat rate representative of the actual cost of serving a typical user in each of these categories. (2) The rate for category C shall be based on winter quarter water use in accordance with the following formula: Cu = VuC Where: Cu = Users charge per billing period. Vu = Volume of winter quarter water use. C = A charge per unit volume of water used based upon the cost of service per unit volume of normal , domestic-strength wastewater. The user shall be charged the greater of this calculated amount or the applicable minimum charge as set forth in Sec. 26-280. If any metered water service customer connects to the wastewater utility or makes a change in the use of the premises or substantially expands such premises, the Director shall make an estimate of the water consumption on such premises during an average winter month based upon a count of plumbing fixtures, consumption of similar customers or other information relevant to such determination and such estimate when made shall be the basis for the wastewater service charge until the actual winter use for the premises can be determined. Section 2. That Section 26-280 of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-280. Service charges established by category. The schedule of rates for each category described in § 26-279 shall be as follows: CATEGORY CLASS OF CUSTOMER RATE A Single-family residential user $15.22 per month (Either flat rate or metered water use) B Duplex (Two-family) $24.80 per month residential users (either flat rate or metered water use) . C Multifamily residential user The greater of $1.43 per 1,000 (more than two dwelling units gallons of winter quarter including mobile home parks) water use or a minimum charge and winter quarter based of $5.97 per month per nonresidential user. dwelling unit served D Minor nonresidential user The greater of $1.43 per 1,000 gallons of water use, measured sewage flow, or winter quarter water use, whichever is applicable, or the following applicable minimum charge Size of water Monthly meter (inches) minimum charge 3/4 or smaller $ 5.97 1 7.91 1 1/2 13.81 2 23.82 3 49.63 4 79.45 6 178.84 E Intermediate nonresidential $1.43 per 1,000 gallons of and user water use, measured wastewater F flow, or winter quarter water Significant industrial user use, whichever is applicable; plus a surcharge of $0.826 per million gallons for each milligram per liter of suspended soils in excess of 250 milligrams per liter; plus a surcharge of $0.666 per million gallons for each milligram per liter of BOD in excess of 200 milligrams per liter or a surcharge of $0.441 per million gallons for each milligram per liter of COD in excess of 300 milligrams per liter, or a surcharge of $1 .278 per million gallons for each milligram per liter of TOC in excess of 100 milligrams per liter, whichever is applicable. The user shall pay either this calculated amount or the applicable minimum charge set forth below, whichever is greater. That Section 26-281, subparagraphs (b) and (d), of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-281. Wastewater strength or industrial surcharge; categories. (b) Various surcharge categories based on customary commercial and industrial activities and the average concentration of BOD, COD and TSS found in wastewater form each such category shall be established and set forth in § 26-282 of this Article. Intermediate nonresidential users of Category E and significant industrial users of Category F shall be classified as one (1) of the surcharge categories. Unless the actual concentrations of the parameters in the user's wastewater are being monitored under the conditions of an industrial discharge permit, calculation of the user's wastewater strength surcharge will be based on the average concentration values established for the applicable surcharge category. (d) The Director shall determine average concentration values for other categories and for any user that does not fall within one of the categories established by § 26-278 of this Article as needed and shall determine the appropriate category for individual users who may request a change in category. If sufficient information has been submitted by the user and if the Director finds that the evidence submitted supports the requested change, the Director shall thereupon effect such change. Section 4. That Section 26-283 (b) of the Code of the City of the City of Fort Collins is hereby amended to read as follows: Sec. 26-283. Sewer plant investment fees (SPIF); basis. (b) The SPIF shall be based on and used for growth related capital expansion costs of wastewater collection, transmission and treatment facilities. The fee shall vary with the number of dwelling units for residential users and the size of the water meter for nonresidential users. The parameters and rates shall be approved by the City Council in the same manner as other utility charges and reviewed annually for adjustments. Section 5. That Section 26-284, subparagraphs (a) , (d) , (e) and the addition of a new (f) , of the Code of the City of Fort Collins be amended and added to read as follows: Sec. 26-284. Sewer plant investment fees and surcharges established. (a) The schedule of sewer plant investment fees (not including surcharges) for users who are not subject to a monthly surcharge as set forth in § 26-281 of this Article, or who are not expected to generate greater than the average daily flow in the month of maximum discharge for the applicable category, is as follows: Category SPIF A $1,600. B and C $1,600. (For the first dwelling unit) $1,165. (For each additional dwelling Water Meter unit) Category Size (inches) Fee D,E,F 3/4 $ 2,000. 1 5,100. 1 1/2 9,100. 2 15,100. G Same as equivalent category, plus any special sanitation district fees. H Negotiated. (d) The amount of the plant investment fee and surcharge for each nonresidential surcharged user, users in category H, and those users who are expected to generate greater than the average daily flow in the month of maximum discharge for the applicable category, shall be calculated utilizing the following formula: SPIF = Flow x [Flow$ +(BOD x BOD,) + (TSS x TSS,)] Where: SPIF = Plant investment fee for category H users and users discharging wastewater with average concentrations of BOD and/or TSS which exceed those average concentrations which are set forth in § 26-282(b) under Category E-34 Flow = The user's average daily flow in the month of maximum discharge as measured in gallons per day. Flow, _ $2.68 per gallon (unit cost of facilities attributable to treating wastewater flow) . BOD Average BOD concentration for user category or measured BOD concentration for the user as determined in accordance with subparagraph (c) of this Section. BOD, _ $0.0044 per mg/l (unit cost of facilities attributable to treating BOD) . TSS = Average TSS concentration for user category or measured TSS concentration for the user as determined in accordance with subparagraph (c) of this Section. TSS, _ $0.0029 per mg/l (unit cost of facilities attributable to treating TSS) . (e) The plant investment fee and surcharge for users in categories D,E,F and G shall be the greater of that calculated utilizing the formula set forth in subparagraph (d) of this Section or the plant investment fee for the applicable water meter size set forth in subparagraph (a) of this Section. (f) For purposes of this Section 26-284, the average daily flow in the month of maximum discharge for users in categories D, E, and F shall be deemed to be: Water Meter Average Daily Flow Size (Inches) (Gallons Per Day) 3/4 467 1 1,190 1 1/2 2,124 2 3,524 Section 6. That the amended rates and charges recited herein shall be imposed on all billings rendered on or after January 1, 1994.
