OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE DRAINAGE EASEMENT ON CHISM PROPERTY
WHEREAS,in 1986,the City's Stormwater Utility was granted a 65 feet by 280 feet drainage
easement from Chism Homes,Inc. for a proposed channel in the McClelland's &Mail Creek Master
Drainage Plan; and
WHEREAS, the Master Drainage Plan has since been revised, requiring a 40 feet by 558.46
feet easement, at the same location; and
WHEREAS,Chism Homes,Inc.,has agreed to dedicate to the City the new easement needed
by the City contingent upon the vacation of the northerly 25 feet of the old easement; and
WHEREAS, the City staff agrees that such a vacation is appropriate; and
WHEREAS, it is necessary and desirable to remove the portion of the easement that is no
longer needed and vacate the easement for said portion; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said portion of easement and that such vacation is in the City's best
interests.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the northerly 25 feet of the drainage easement described in that Easement Dedication
recorded on April 17, 1986, at Reception No. 8601917 of the Larimer County Public Records be,
and the same hereby is, vacated, abated, and abolished.
Introduced, considered favorably on first reading, and ordered published this 3rd day of
December, A.D. 1996, and to be presented for final passage on the 17th day'of December, A.D.
