HomeMy WebLinkAbout143 - 12/03/1996 - AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED BY AND BETWEEN CITY OF FORT COLLINS AS GRANTOR AND GE ORDINANCE NO. 143, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED BY AND BETWEEN THE CITY OF FORT COLLINS AS GRANTOR AND GENE R. LITTLE AS GRANTEE WHEREAS, on December 14, 1965,Ronald E. Bockman and Sally June Bockman conveyed a portion of their property to Dewey Johnson and retained a 40 foot wide portion of said property as a"right-of-way for road purposes" as described in the deed recorded December 17, 1965 at Page 526 of Book 1314 of the Latimer County, Colorado Records; and WHEREAS, said deed does not constitute a proper dedication of property to the City for right-of-way purposes and said right-of-way was never accepted by the City of Fort Collins; and WHEREAS, no public street improvements were constructed on said right-of-way; and WHEREAS, the City has since constructed the Collindale Golf Course on the property to which the right-of-way was to provide access; and WHEREAS, said right-of-way is no longer necessary nor desirable to retain for road or access purposes to the golf course; and WHEREAS, the City has not claimed to have any interest in the parcel of real property upon which said right-of-way was retained, nor is any such interest necessary or desirable for future public access on or across said parcel; and WHEREAS, in order to clear the title to the property, it is necessary and desirable that the City execute a quit claim deed, relinquishing any claim it may have to the property; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the execution of the proposed quit claim deed by and between the City and Gene R. Little and to do so is in the best interests of the City. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute a quit claim deed by and between the City of Fort Collins, Colorado, a municipal corporation, as Grantor, and Gene R. Little, as Grantee, conveying all rights, title and interest that the City may have in that parcel of real property described on Exhibit"A" attached hereto and incorporated herein by this reference. The Council also finds that conveying said property to Gene R. Little is in the City's best interests. More particularly described as follows: Commencing at the Northwest Corner of said Section 31; thence S 43°45'45" E 1830.92 feet; thence S 21 000'40" W 212.05 feet; thence S 60°19'00" E 85.94 feet to the TRUE POINT OF BEGINNING, said point being on the Easterly Right-of-Way of Lemay Avenue; thence S 60'19'00" E 124.06 feet; thence S 00°00'00" E 46.04 feet to a point 40.00 feet South of the North line of a tract described in Book 1314, Page 526; thence along a line parallel with said line N 60'19'00" W 133.75 feet to a point on the Easterly Right-of-Way line of Lemay Avenue said point being on a curve concave to the West having a central angle of 01°55'46" and a radius of 1250.00 feet the chord of which bears N 11 032'09" E 42.09 feet; thence along the are of said curve 42.10 feet to the TRUE POINT OF BEGINNING.
