HomeMy WebLinkAbout138 - 11/19/1996 - RESCINDING LOCAL LANDMARK DESIGNATION OF ROSENOFF/SMITH HOUSE, 508 WEST OLIVE ORDINANCE NO. 138, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS RESCINDING THE LOCAL LANDMARK DESIGNATION OF THE ROSENOFF/SMITH HOUSE, 508 WEST OLIVE STREET, AS A LOCAL LANDMARK PURSUANT TO CHAPTER 14 OF THE CODE OF THE CITY OF FORT COLLINS WHEREAS, it is a matter of public policy that the protection, enhancement and perpetuation of sites, structures and districts of historical, architectural or geographic significance, located within the City, are a public necessity and are required in the interest of prosperity, civic pride and general welfare of the people; and WHEREAS, it is the opinion of the City Council that the economic, cultural and aesthetic standing of this City cannot be maintained or enhanced by disregarding the historical, architectural and geographic heritage of the City and by ignoring the destruction or defacement of such cultural assets; and WHEREAS, in furtherance of the foregoing policy objectives, the Rosenoff/Smith House at 508 West Olive Street (the "Property") was designated as a Local Landmark on June 4, 1996, by action of the City Council, upon the recommendation of the Landmark Preservation Commission; and WHEREAS, the owner of the Property has since requested that the Council rescind such landmark designation; and WHEREAS, the Landmark Preservation Commission has recommended to the Council that said designation should be rescinded because the integrity of the Rosenoff/Smith House at 508 West Olive Street, and its ability to convey the characteristics of the Craftsman bungalow architectural style are compromised; and that the benefits accruing in maintaining this property on the list of individual Local Landmarks for its architectural importance do not outweigh the negative impact of insisting upon such designation over the owner's desires; and WHEREAS, Section 14-31 of the Code of the City provides that the designation of property as a local landmark may be rescinded by the Council by ordinance; and WHEREAS, the Council, recognizing that all requests for rescission should be carefully reviewed on a case-by-case basis, has undertaken such review and determined that in this particular instance it is in the best interests of the citizens of the City that the designation as a Local Landmark of the Rosenoff/Smith House be rescinded. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the designation of the Rosenoff/Smith House as a Local Landmark pursuant to Chapter 14 of the Code of the City, which house is located on the lands in the City of Fort Collins, Larimer County, Colorado, described as follows, to-wit: Commencing 40 feet East of the Southwest Corner of Lot 1, Block 72, thence East 45 feet, North 55 feet, West 45 feet, South 55 feet to beginning, City of Fort Collins, County of Larimer, State of Colorado. Also known as 508 West Olive Street, Fort Collins, Colorado be and hereby is rescinded. Introduced, considered favorably on first reading, and ordered published this 5th day of November, A.D. 1996, and to be presented for final passage on the 19th day of A.D. 1996.
