OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 20-1 OF THE CODE OF THE CITY
REGARDING AIR POLLUTION NUISANCES
WHEREAS,pursuant to Ordinance No. 180, 1987, Section 20-1 of the Code of the City was
amended by the addition of a new subsection (b) to prohibit the burning of cottonwood for heating
or recreation in residences because of the offensive odor emitted by such wood when it is burned;
and
WHEREAS, at the July 23, 1996 Council Study Session, the Council directed the staff to
proceed with a review of the City's ordinances relating to wood smoke pollution and to make
revisions where necessary; and
WHEREAS, after consultation with the City Forester and the Colorado State Forest Service,
staff believes that the burning of cottonwood does not pose a significant air quality nuisance risk to
the City; and
WHEREAS, the Council has therefore determined that it is in the best interest of the citizens
of the City that subsection (b) of Section 20-1 should be repealed.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 20-1 of the Code of the City be amended by the deletion of subsection (b)
and the relettering of subsequent subsections accordingly.
