OF THE COUNCIL OF THE CITY OF FORT COLLINS
00 VACATING A PORTION OF THE STREET RIGHT-OF-WAY
00 FOR BUCHANAN STREET IN BRITTANY KNOLLS P.U.D. FILING NO. 2

WHEREAS, the original plat entitled "Brittany Knolls P.U.D. Filing No.2" (the P.U.D)
contained the dedication of right-of-way for Buchanan Street to extend to the west property line
of said P.U.D.; and
WHEREAS, Buchanan Street was constructed to said property line in order to be
ww extended to the west to connect to future development; and

N w WHEREAS, subsequently, the City purchased the property to the west of the P.U.D. for
0 natural area purposes thereby eliminating the possibility of an extension of Buchanan Street
w beyond the west property line of the P.U.D.; and

rD H WHEREAS, a portion of the Buchanan Street is no longer necessary to serve the lots in
w "' the P.U.D. or any future development; and

U WHEREAS, it is necessary and desirable to remove the portion of the street that is no
0 yH longer in use and vacate the right-of-way for said portion, more particularly described below; and

m o WHEREAS, the owners of Lots 29 and 30 in the P.U.D. have executed a private access
o u easement agreement so that a driveway can be constructed to serve the existing house on Lot 29
�1 w of the P.U.D.; and

WHEREAS, all public and private utility agencies and the Poudre Fire Authority have

a been notified of the proposed vacation and report no objection; and
o
i w WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
0 o injured by the vacation of said right-of-way.

rn a NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
LO a FORT COLLINS that the portion of the right-of-way for Buchanan .street in the Brittany Knolls

U, P.U.D. Filing No. 2, more particularly described as follows, to wit:

U z Beginning at the Northwest corner of Lot 30, Brittany Knolls P.U.D. Filing No. 2, City of
H o Fort Collins, Larimer County, Colorado, thence North 00°00'00" East along the Westerly
U a boundary of Brittany Knolls P.U.D. Filing No. 2, with all bearings contained herein
a relative thereto, 54.00 feet; thence South 89*01'02" East, 100.03 feet; thence South
00°00'00" West, 68.77 feet; thence along a curve to the left 23.30 feet, having a central
angle of 89'01'02", a radius of 15.00 feet and along chord which bears North 44°30'31"
West, 21.03 feet; thence North 89°01'02" West 85.29 feet, to the True Point of Beginning
