HomeMy WebLinkAbout020 - 03/03/1998 - GRANTING THREE TEMPORARY EASEMENTS ON MEADOW SPRINGS RANCH TO THE COLORAO DEPARTMENT OF TRANSPORTATI ORDINANCE NO. 20, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS GRANTING THREE TEMPORARY EASEMENTS ON MEADOW SPRINGS RANCH TO THE COLORADO DEPARTMENT OF TRANSPORTATION WHEREAS, the City of Fort Collins Water Utility is the owner of real property located in Larimer County, Colorado, known as Meadow Springs Ranch; and WHEREAS,in connection with a resurfacing and snow abatement improvement project,the Colorado Department of Transportation("CDOT") wishes to acquire three (3) two-year temporary easements at three locations along the I-25 corridor on Meadow Springs Ranch, described on Exhibit "A", attached hereto and incorporated herein by this reference (the "Property"), to permit cutting and filing activities on said Property in exchange for the payment by CDOT of$370, which represents the fair market value of these easements; and WHEREAS, CDOT has agreed to re-seed and re-fence the Property and return it to a condition satisfactory to the City upon completion of its activities; and WHEREAS, Section 23-111(a)of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City of Fort Collins; and WHEREAS,with respect to the sale or disposition of real property that is part of the City's water or utility systems, Section 23-111 (b) requires that the City Council also find that the disposition will not materially impair the viability of that utility system as a whole, and that it will be for the benefit of the citizens of the City. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds that the conveyance of the above-described three temporary easements under and through the Property is in the best interest of the citizens of the City of Fort Collins. Section 2. That the City Council further finds that the above-described conveyance of three temporary easements under and through the Property will not materially impair the viability of the Water Utility. Section 3. That the City Manager is hereby authorized to negotiate and execute three(3) Temporary Easement Agreements conveying two-year temporary easement interests under and through the Property to the Colorado Department of Transportation in exchange for a total payment of$370,and including such other terms and conditions as the City Manager, in consultation with the City Attorney, deems appropriate to protect the interests of the City.
