HomeMy WebLinkAbout187 - 11/03/1998 - APPROPRIATING UNANTICIPATED REVENUE IN THE FLOOD RECOVERY FUND AND AUTHORIZING THE TRANSFER OF APPRO ORDINANCE NO. 187, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE FLOOD RECOVERY FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE FLOOD RECOVERY FUND AND THE GENERAL. FUND WHEREAS, on July 28 and 29, 1997, certain areas of the City were severely damaged and five lives were lost due to the flooding of Spring Creek; and WHEREAS,the flood destroyed or severely damaged numerous mobile homes and vehicles located in the Johnson Center Mobile Home Park and the South College Trailer Park; severely damaged public and private infrastructure; caused the evacuation of residences and businesses; caused the temporary closure of businesses; and caused the loss or destruction of various items of personal property; and WHEREAS, the City Council adopted Ordinance No. 132, 1997, on August 5, 1997, appropriating $2,500,000 from prior year reserves (Emergency Reserve) in the General Fund to be used for repair and maintenance of public facilities and flood incident services; and WHEREAS, the City has received damage reimbursement payments from the Federal Emergency Management Agency (FEMA), the Federal Highway Administration (FHWA), and insurance proceeds, none of which have been appropriated in the Flood Recovery Fund; and WHEREAS, the City will use the aforementioned payments, totaling $1,107,565, to cover expenditures incurred for the repair and maintenance of public facilities and for flood incident services,and to provide partial reimbursement to the City's General Fund Emergency Reserve;and WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the Council to appropriate unanticipated revenue received at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Flood Recovery Fund, the sum of NINE HUNDRED FIFTY-SEVEN THOUSAND FIVE HUNDRED SIXTY-FIVE DOLLARS ($957,565) representing insurance reimbursements and payments from the Federal Emergency Management Agency and the Federal Highway Administration to be used for flood related expenditures. Section 2. That the amount of ONE HUNDRED FIFTY THOUSAND DOLLARS ($150,000) is hereby appropriated in the Flood Recovery Fund and authorized for transfer to the General Fund Emergency Reserve.
