HomeMy WebLinkAbout170 - 10/20/1998 - AMENDING THE CITY CODE RELATING TO BICYCLISTS RIDING ON RECREATIONAL TRAILS ORDINANCE NO. 170, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 28-17 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO BICYCLISTS RIDING ON RECREATIONAL TRAILS WHEREAS,Section 17-18(b)of the City's Model Traffic Code currently requires bicyclists when riding upon a sidewalk or a crosswalk in the City to yield the right-of-way to pedestrians using the sidewalk or crosswalk and to give an audible signal before overtaking and passing such pedestrians; and WHEREAS,there is currently no other comparable provision in the City Code that imposes such requirements on bicyclists using the City's recreational trails; and WHEREAS, the Council has determined that it is necessary for the public's health, safety and welfare that bicyclists riding upon the City's recreational trails be required to yield the right-of- way to pedestrians using such trails and to give an audible signal before overtaking and passing such pedestrians. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That Section 28-17 of the Code of the City of Fort Collins be amended by the addition of a new subsection (14.9) for the purpose of adding a new Section 17-24 to the "Model Traffic Code for Colorado Municipalities", 1977 Edition, which shall read as follows: Sec. 28-17. Amendments to the adopted code. (14.9) Section 17-24, Ridingon recreational trails, is hereby added whichreads as follows: "Sec. 17-24. Riding on recreational trails. "A person riding a bicycle upon and along a recreational trail shall yield the right-of-way to any pedestrian using the recreational trail and shall give an audible warning signal before overtaking and passing any such pedestrian. For purposes of this Section, a recreational trail shall be deemed to be any trail or path that is not a sidewalk and which is owned and maintained by the city for use by the public for any recreational purpose, whether such trail or path is paved or not and whether it is located within or outside the city limits." Section 2. That the existing Section 28-17, subsection (14.9) be renumbered as subsection (14.10).
