HomeMy WebLinkAbout017 - 02/17/1998 - REZONING THE NAUTA REZONING, WITHDRAWN BY APPLICANT BEFORE SECOND READING ORDINANCE NO. 17, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN AS THE NAUTA REZONING WHEREAS, Division 1.3 of the Land Use Code of the City of Fort Colli establishes the Zoning Map and Zone Districts of the City; and WHEREAS, Division 2.8 of the Land Use Code of the City of F Collins establishes procedures and criteria for reviewing the rezoning of land; and WHEREAS, Division 4.9(c) of the Land Use Code provides t the owner of any property in the T Transition district may at any time petition the City to remo the property from said district and place it in another zone district following the recommend on of the Planning and Zoning Board; and WHEREAS,Division 4.9(c)further provides that th ouncil must change the zoning district for any such property in the T Transition district within xty (60) days from the date the matter is considered by the Board; and WHEREAS, the property that is the subjec f this Ordinance is located in the T Transition district, the owner thereof has petitioned the C' y to remove the property from said district, the petition has been referred to the Planning and ping Board and a recommendation from the Board was rendered to the Council on January 15, 998; and WHEREAS, in accordance wit e foregoing, the Council has considered the rezoning of the property which is the subject of t ' ordinance, and has determined that the said property should be rezoned as hereafter provided. NOW THEREFORE, IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. t the Zoning Map adopted by Division 1.3 of the Land Use Code of the City of Fort Collins be and the same hereby is, amended by changing the zoning classification from "T",Transition Zon istrict,to "LMN",Low-Density Mixed-Use Neighborhood Zone District, for the following des bed property in the City known as the Nauta Rezoning: A trac f land situated in the SW'/4 of Section 6, Township 7 North, Range 68 West of t 6th P.M., Latimer County, Colorado. Considering the south line of said Se ion 6 as bearing N 88°15'16" E and all bearings contained herein relative thereto: ommencing at the southwest corner of said Section 6; thence N 88'15'16" E 285.00 feet; thence N 00°02144" W 30.00 feet to the true point of beginning; thence N Withdrawn by applicant before Second Reading 88015'16" E 500.01 feet; thence N 00002'44" W 425.17 feet; thence S 89057'16" W 499.79 feet; thence S 00002'44" E 440.05 feet to the true point of beginning. Section 2. That the Sign District Map adopted pursuant to Section 3.8.7(E) of the Land Use Code of the City of Fort Collins be, and the same hereby is, changed and amended by showing that the above-described property is included in the Residential Neighborhood Sign District. Section 3. The City Engineer is hereby authorized and directed to amend said Zoning Map in accordance with this Ordinance.
