HomeMy WebLinkAbout075 - 05/05/1998 - APPROPRIATING UNANTICIPATED REVENUE IN THE FLOOD MITIGATION FUND FOR FLOOD MITIGATION PROJECTS ORDINANCE NO. 75, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE FLOOD MITIGATION FUND TO BE USED FOR FLOOD MITIGATION PROJECTS WHEREAS,on July 28 and 29, 1997,a flash flood hit Fort Collins, causing severe damage to certain areas of the City and resulting in the loss of five (5) lives and injuries to 54 people; and WHEREAS,the flood destroyed 120 mobile homes and damaged vehicles;severely damaged public and private infrastructure; caused the evacuation of residences and businesses; caused the temporary closure of businesses; and caused the loss or destruction of various items of personal property; and WHEREAS,on August 1, 1997,President Clinton declared Larimer County a federal disaster area thereby qualifying the City for various types of disaster assistance programs, including assistance from the Federal Emergency Management Agency (FEMA), the Small Business Administration (SBA), and the Department of Housing and Urban Development (HUD); and WHEREAS,on January 28, 1998,HUD announced that the City would receive$511,740 of Disaster Recovery Initiative Funds from the Community Development Block Grant Program (CDBG), providing funds for flood-related needs which are not met by other federal programs; and WHEREAS, contingent upon receiving the Disaster Recovery Initiative Funds, the City is required to develop a Flood Recovery Action Plan, identifying specific projects to which the funds would be allocated; and WHEREAS, the City's CDBG Commission, City staff, and various agencies and citizens have worked together to develop a Flood Recovery Action Plan including conducting public hearings, culminating in a recommendation to the City Council of projects to be funded; and WHEREAS,on April 21, 1998,City Council adopted Resolution 98-75,approving the City's Flood Recovery Action Plan and accepted the recommendations contained therein with regard to projects to be funded upon the receipt of Disaster Recovery Initiative Funds from the Department of Housing and Urban Development, Community Development Block Grant; and WHEREAS,accounting for large grants is better accomplished in a separate fund where grant revenues and expenditures can be separately identified and segregated from other revenues and expenditures; and WHEREAS,Article V, Section 25 of the Charter of the City of Fort Collins(the"Charter") authorizes the Financial Officer to create new funds; and WHEREAS, the Financial Officer has created the Flood Mitigation Fund to more appropriately account for expenditures and revenue related to flood mitigation measures; and WHEREAS, Article V, Section 9, of the "Charter" permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in conjunction with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of$511,740, in the Flood Mitigation Fund, upon receiving Disaster Recovery Initiative Funds from the Department of Housing and Urban, Community Development Block Grant to be used for projects identified and recommended for funding in the City's Flood Recovery Action Plan. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from Disaster Recovery Initiative Funds in the Flood Mitigation Fund, the sum of FIVE HUNDRED ELEVEN THOUSAND SEVEN HUNDRED FORTY DOLLAR ($511,740) from the Department of Housing and Urban Development to be used for projects recommended in the City's Flood Recovery Action Plan. Introduced and considered favorably on first reading and ordered published this 21 st day of April, A.D. 1998, and to be presented for final passage on the 5th day,Iff May, A.D- 1998. .
