HomeMy WebLinkAbout026 - 03/17/1998 - AMENDING THE CITY CODE PERTAINING TO ELECTION DISTRICTS ORDINANCE NO. 26, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 7, ARTICLE III OF DIVISION 3 OF THE CITY CODE PERTAINING TO ELECTION DISTRICTS WHEREAS, on April 8, 1997, the electorate of the City approved certain amendments to the City Charter; and WHEREAS, among such amendments was an amendment to Article II, Section 1(c) of the Charter pertaining to redistricting; and WHEREAS, said Article II, Section 1(c) states that the Council shall provide by ordinance for the giving of notice of any redistricting proceedings and the manner of protesting such proceedings; and WHEREAS, Chapter 7, Article III, Division 3 of the City Code, pertaining to election districts should be amended so as to include such provisions. NOW, THEREFORE, BE IT ORDAINED BY "THE COUNCIL OF THE CITY OF FORT COLLINS, that Chapter 7, Article III, Division 3 of the Code of the City of Fort Collins is hereby amended by the addition of two new sections,to be numbered Sections 7-87 and 7-88, respectively, which shall read in their entirety as follows: Sec. 7-87 Redistricting; notice. The Council shall, by ordinance, amend the boundaries of the foregoing districts as necessary to comply with the provisions of Article II, Section 1(d) of the Charter. The City Clerk shall cause to be published twice, in a local newspaper of general circulation in the city, notice of the date, time and place of the Council's consideration of any such redistricting ordinance. The first such notice shall be published no less than fourteen (14) days prior to the date of first hearing of the redistricting ordinance,and the second notice shall be published no less than ten(10) days prior to the date of the first reading of the same. Sec. 7-88 Protest procedure. Any registered elector desiring to protest the manner of redistricting proposed in any such redistricting ordinance may file a written protest, under oath, in the office of the City Clerk. Said notice of protest shall be tiled no less than seven (7) days prior to the date upon which the proposed redistricting ordinance is to be heard by the Council on first reading. The notice of protest shall set forth with particularity the grounds of the protest. Such protest shall be heard, considered and resolved by the Council no later than the date of first reading of the proposed redistricting ordinance.
