HomeMy WebLinkAbout024 - 03/17/1998 - AMENDING THE CITY CODE RELATING TO CANDIDATES FOR MUNICIPAL OFFICE ORDINANCE NO. 24, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING ARTICLE IV OF CHAPTER 7 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO CANDIDATES FOR MUNICIPAL OFFICE WHEREAS,on April 8, 1997,the electorate of the City approved certain amendments to the City Charter; and WHEREAS, one such amendment was an amendment to ArticleVIII, Section 3 of the City Charter, which provided that the Council shall set by ordinance the timeframe for circulation and submittal of nominating petitions and the deadline for withdrawal from candidacy for municipal office; and WHEREAS,the City Council believes that the timeframe to begin circulation of nominating petitions should be set at sixty (60) days prior to the date of said election and the deadline for submittal of such nominating petitions should be set at forty (40) days prior to the date of said election; and WHEREAS, the Council believes that the deadline for withdrawal from candidacy for municipal office should be set at thirty (30) days prior to the date of said election; and WHEREAS, said periods of time and deadlines would provide the City Clerk with an adequate opportunity to prepare the ballot for the ensuing election. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that a new Section 7-116 shall be adopted as follows, and the existing Section 7-116 of the Code of the City of Fort Collins renumbered accordingly: Sec. 7-116. Nomination of candidates; withdrawal from candidacy. A nominating petition required pursuant to Article VIII of the Charter may not be circulated earlier than sixty (60) days before the election and must be filed with the City Clerk not later than forty (40) days before the election. A person who has been nominated may, not later than thirty (30) days before the election,withdraw by filing with the City Clerk a request therefor in writing, and no name so withdrawn shall be placed upon the ballot.
