HomeMy WebLinkAbout023 - 03/03/1998 - AUTHORIZING THE SALE OF CITY-0WNED NATURAL AREA LAND AND RELATED EASEMENTS TO THE COLORADO DEPARTMEN ORDINANCE NO. 23, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE SALE OF CITY-OWNED NATURAL AREA LAND AND RELATED EASEMENTS TO THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF THE HARMONY/1-25 TRANSPORTATION TRANSFER CENTER WHEREAS, the City of Fort Collins is the owner of certain real property to the northwest of the intersection of Harmony Road and Interstate 25, entitled the Arapaho Bend Natural Area, in Fort Collins, Larimer County, Colorado (the "Natural Area"); and WHEREAS, in connection with the development of a Transportation Transfer Center facility at the interchange of Harmony Road and Interstate 25 (the "Project"), the Colorado Department of Transportation ("CDOT") has offered to purchase a portion of the Natural Area closest to the interchange totalling approximately eight(8) acres in size, more particularly described in Exhibit "A", consisting of six (6) pages, attached hereto and incorporated herein by this reference (the "Property"), in order to construct a portion of its Project on the Property; and WHEREAS, in addition, in connection with the Project, CDOT has requested that the City convey to CDOT two easements for the construction and maintenance of improvements related to the Project over two additional parcels that are part of the Natural Area, which parcels total approximately one-quarter of an acre and are more particularly described in Exhibit "B", consisting of four (4) pages, attached hereto and incorporated herein by this reference (the "Easement Property"); and WHEREAS, City staff has worked extensively with CDOT on the design and planning for the Project, and supports the construction of the Project as beneficial for the enhanced safety and efficiency of the Harmony and Interstate 25 interchange area for all modes of transportation; and WHEREAS, the sale of the Property and the proposed easements over the Easement Property,the proceeds of which shall be used to reimburse the Natural Areas Fund, is consistent with the objectives of the City's natural area policies and plans, and with the Council's intent in purchasing the Property, as set forth in Resolution 95-7.. adopted January 3, 1995; and WHEREAS, City staff is negotiating with CDOT a final total payment of no less than $136,730 for the Property and Easement Property, along with related terms and conditions; and WHEREAS,the sale of the Property and conveyance of the easements to CDOT is necessary for the cost-effective development of the Project, and will result in a reimbursement to the Natural Areas Fund of the cost associated with the purchase of the Project; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to dispose of any and all interests in real property owned in the name of the City, provided that Council first finds that the proposed disposition of that property is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the proposed sale to CDOT of that Property more particularly described on Exhibit"A", attached hereto, and incorporated herein by this reference, is in the best interest of the City. Section 2. That the City Manager is hereby authorized to negotiate and execute an agreement conveying the Property to CDOT, which agreement shall be consistent with the terms hereof and may contain such other provisions as the City Manager, in consultation with the City Attorney, deems appropriate to protect the interests of the City. Section 3. That the City Council hereby determines that the proposed conveyance to CDOT of construction and maintenance easements over the Easement Property, as more particularly described on Exhibit `B", attached hereto and incorporated herein by this reference, is in the best interest of the City. Section 4. That the City Manager is hereby authorized to negotiate and execute deeds of easement conveying easements over the Easement Property to CDOT, which deeds of easement shall be consistent with the terms hereof and may contain such other provisions as the City Manager, in consultation with the City Attorney, deems appropriate to protect the interests of the City. Section 5. That all proceeds from the sale of the Property shall be deposited in the Natural Areas Fund, consistent with Ordinance No. 97, 1992, as approved by the registered electors of the city on November 3, 1992.
