HomeMy WebLinkAbout227 - 12/15/1998 - AUTHORIZING THE CITY TO ENTER INTO A THREE-YEAR FARM LEASE AGREEMENT WITH GREG WALKER FOR FARMING TH ORDINANCE NO. 227, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY OF FORT COLLINS TO ENTER INTO A THREE-YEAR FARM LEASE AGREEMENT WITH GREG WALKER FOR FARMING OF THE RESOURCE RECOVERY FARM WHEREAS, in 1979,the City purchased 328 acres east of the Wastewater Treatment Plant #2 at Prospect Street and 1-25, now known as the Resource Recovery Farm (the "Farm"); and WHEREAS, a portion of said land was leased for farming purposes until the City installed a sludge disposal system in 1982; and WHEREAS, in 1988, the City began growing crops on the Farm for the purpose of recovering expenses of sludge application; and WHEREAS,during the years from 1988 through 1990,profits offset operating expenses;and WHEREAS,in 1990 through 1993, market conditions changed and farm operations proved to be unprofitable; and WHEREAS, in 1994,City staff recommended that the Farm be returned to contract farming and,with approval of the City Council,did so by leasing the Farm to Greg S.Walker("Walker")for a term ending on December 31, 1995; and WHEREAS,in 1996,City staff again recommended that the farming operations for the Farm be contracted out to a local farmer and towards this end a Request for Proposal to lease the Farm was issued and the City received one proposal from Walker, and WHEREAS,Walker leased the Farm for agricultural purposes for a two-year term beginning February 15, 1996, and ending on February 14, 1998, for the sum of Seven Thousand Dollars ($7,000) each year; and WHEREAS, City staff again recommends that the farming operations for the Farm be contracted out to a local farmer and towards this end a Request for Proposal to lease the Farm was issued and the City received one proposal from Walker; and WHEREAS, Walker has offered to lease the Farm for agricultural purposes for a three-year term beginning January 1, 1999,and ending on December 31, 2001,for the sum of Eight Thousand Two Hundred and Eleven Dollars ($8,211) each year; and WHEREAS,City staff and Walker have negotiated a Lease Agreement containing Walker's said offer, a copy of which is on file with the City Clerk's office (the "Lease Agreement"); and WHEREAS, the Farm constitutes a part of the City's Wastewater utility System; and WHEREAS, Section 23-114 of the Code of the City of Fort Collins authorizes City Council to lease the Farm to Walker for a three-year term,provided that the Council finds,by ordinance,that: (1) it is in the best interests of the City; (2) it will not materially impair the viability of the City's Wastewater Utility System as a whole; and (3) it will be for the benefit of the citizens of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that the City's lease of the Farm to Walker on the terms and conditions described in the Lease Agreement are in the best interests of the City,that it will not materially impair the viability of the City's Wastewater Utility System as awhole,and that it will be for the benefit of the citizens of the City. Section 2. That the Council hereby approves the Lease Agreement. Section 3. That the Council hereby authorizes the lease of the Farm to Walker on the terms and conditions set forth in the Lease Agreement. Section 4. That the Council hereby authorizes the Mayor to execute the Lease Agreement on behalf of the City.
