HomeMy WebLinkAbout037 - 03/17/1998 - AUTHORIZING THE CONVEYANCE OF STREET RIGHT-OF-WAY AND THE GRANT OF A NON-EXCLUSIVE SLOPE AND DRAINAG ORDINANCE NO. 37, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CONVEYANCE OF STREET RIGHT-OF-WAY AND THE GRANT OF A NON-EXCLUSIVE SLOPE AND DRAINAGE EASEMENT TO THE CITY OF LOVELAND WHEREAS,the City of Fort Collins is the owner of a 33.34% interest in the land known as the Ute-Snowy Ridge Property, located in Larimer County, Colorado; and WHEREAS,the City of Loveland has proposed to widen 71 st Street in Loveland as a major collector street, through its street oversizing program, to address traffic volume and safety issues raised by the development of adjacent properties (the "Project"); and WHEREAS, in order to complete the Project, the City of Loveland must acquire from the City of Fort Collins its interest in .120 acres of the Ute-Snowy Ridge Property for a 20-foot street right-of-way, more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference (the "Right-of-Way"); and WHEREAS, the Project further requires that the City of Loveland acquire from the City of Fort Collins a permanent non-exclusive 45-foot slope and drainage easement, more particularly described on Exhibit `B", attached hereto and incorporated herein by this reference (the "Easement"); and WHEREAS, City staff has determined that the conveyance of the Right-of-Way and Easement would not have a detrimental impact on the Ute-Snowy Ridge Property, and recommend the approval of said conveyance; and WHEREAS, the City of Loveland has agreed that, in exchange for these conveyances, $1,000, representing the fair market value of the interests conveyed, will be paid to the City's Natural Areas Fund; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interests of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That the above-described sale and conveyance of the Right-of-Way and Easement is in the best interests of the City of Fort Collins. Section 2. That the City Manager is authored to execute such documents as may be necessary and appropriate to convey the Right-of-Way and Easement to the City of Loveland. City Clerk DESCRIPTION: PARCEL A - ADDITIONAL RIGHT-OF-WAY A tract of land located in the Southeast Quarter of Section 23, Township 6 North, Range 69 West of the 6th Principal Meridian, Larimer County, Colorado, being more particularly described as follows: Considering the South line of the Southeast Quarter of said Section 23 as bearing North 89'02'12" East with all bearings contained herein relative thereto. DESCRIPTION FOR A PERMANENT NON-EXCLUSIVE DRAINAGE AND SLOPE EASEMENT A permanent drainage and slope easement located in Section 26, Township 6 North, Range 69 West of the 6th Principal Meridian, City of Loveland, County of Larimer, State of Colorado, being more particularly described as follows: Considering the East Line of the Northeast Quarter of said Section 26 as bearing South 00'15'00" East from a 3 1/4" aluminum cap in a range box, at the Northeast Corner of said Section 26, to a 3 1/4" aluminum cap in a range box, at the East Quarter Corner of said Section 26 and with and with all bearings contained herein relative thereto: Commencing at the Northeast Corner of said Section 26; thence, South 89°02'12" West, 50.00 feet to a point on the West Right-of-Way line of North Garfield Avenue; thence along said West Right- of-Way line,North 00'15'00" West, 50.00 feet to a point on the Proposed North Right-of-Way line shown on the plat of Longview-Midway First Subdivision, said point also being the POINT OF BEGINNING; thence along said Proposed North Right-of-Way line, South 89°02'12" West, 100.62 feet to a point on a curve concave to the Southwest having a central angle of 32°12'20", a radius of 325.00 feet, and the chord of which bears South 72°56'03" West, 180.28 feet, thence along the arc of said curve, 182.68 feet to a point on a non-tangent line, said point also being on the North line of Longview-Midway First Subdivision, thence along said North line of Longview-Midway First Subdivision, South 89°02'12" West, 74.32 feet to a non- tangent curve concave to the Southwest having a central angle of 41°59'31", a radius of 370.00 feet, and the chord of which bears North 68°02'27" East, 265.14 feet, thence along the arc of said non-tangent curve, 271.17 feet; thence, North 89°0212" East, 101.18 feet to a point on the West Right-of-Way line of North Garfield Avenue; thence along said West Right-of-Way line, South 00°15'00" East, 45.00 feet to the Point of Beginning.
