HomeMy WebLinkAbout154 - 10/06/1998 - APPROPRIATING UNANTICIPATED REVENUE IN THE CULTURAL SERVICES AND FACILITIES FUND AND AUTHORIZING THE ORDINANCE NO. 154, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CULTURAL SERVICES AND FACILITIES FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE GENERAL FUND AND THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND AND APPROVING THE COMMISSION OF "HUMAN SPIRIT" WHEREAS, on July 28 and 29, 1997, a flash flood hit Fort Collins (the "Flood"), causing severe damage to certain areas of the City and resulting in the loss of five lives and injuries to 54 people; and WHEREAS,the Flood will long be remembered not only for the destruction and loss of lives it caused, but also for the acts of heroism of individuals during the Flood, and the efforts of the community as a whole in responding to the Flood and in providing support for flood victims and restoring the City in the months that followed the Flood, and WHEREAS, a Commemorative Sculpture Selection Subcommittee, consisting of Art in Public Places Board members, community members, a student and professor from Colorado State University, and representatives from the Water Board and the Parks and Recreation Board, was formed to review proposals and select an artist to create artwork that would serve as a commemoration of the Flood; and WHEREAS, Section 23-308 of the City Code requires that the Council approve the use of reserve account funds in excess of$10,000 for the acquisition,installation and maintenance of works of art; and WHEREAS,the Commemorative Sculpture Selection Subcommittee selected Jack Kreutzer to create a sculpture for Creekside Park entitled"Human Spirit,"and the Art in Public Places Board reviewed and approved the Subcommittee's selection at its August 20, 1998, meeting; and WHEREAS,the artist's proposed, commemorative sculpture,consisting of a group of three life-sized bronze figures holding a child and a dog, will depict and capture the community's spirit, not only the night of July 28,but during the many days, weeks,and months that followed the Flood; and WHEREAS, $50,000 is needed to pay artist honorariums and to purchase and install the art work, as well as set aside funds for ongoing maintenance of the sculpture; and WHEREAS, the City has received $8,000 through donations received by the Chamber of Commerce and will contribute$5,000 from the Community Opportunity Investments account in the General Fund so that work can commence on the sculpture; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to authorize the appropriation of$8,000, from donations, in the Art in Public Places reserve account in the Cultural Services and Facilities Fund, and authorize the transfer of$5,000 from the Community Opportunity Investments account in the General Fund to the Art in Public Places reserve account in the Cultural Services and Facilities Fund, to be used for the sculpture "Human Spirit' for Creekside Park, as proposed by Jack Kreutzer. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Art in Public Places reserve account in the Cultural Services and Facilities Fund, the sum of EIGHT THOUSAND DOLLARS ($8,000) from donations to be used for the commission of a commemorative sculpture project at Creekside Park. Section 2. That the unexpended appropriated amount of FIVE THOUSAND DOLLARS ($5,000)is hereby authorized for transfer from the Community Opportunity Investments account in the General Fund to the Art in Public Places reserve account in the Cultural Services and Facilities Fund,and appropriated therein,to be used for the commission of a commemorative sculpture project at Creekside Park. Section 3. That the expenditure of up to THIRTEEN THOUSAND DOLLARS ($13,000) from the Art in Public Places reserve account in the Cultural Services and Facilities Fund,to be used for the commission of artist Jack Kreutzer for the creation of the sculpture "Human Spirit' at Creekside Park, as approved by the Art in Public Places Board on August 20, 1998, is hereby authorized.
