HomeMy WebLinkAbout006 - 02/02/1993 - AMENDING CITY CODE RELATING TO WASTEWATER SURCHARGE RATES BASED ON TEST FOR TOTAL ORGANIC CARBON ORDINANCE NO. 6, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING ARTICLE IV OF CHAPTER 26 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO WASTEWATER SURCHARGE RATES BASED ON A TEST FOR TOTAL ORGANIC CARBON BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following Sections of Article IV of Chapter 26 of the Code of the City of Fort Collins are amended as follows: Section 1 . That 26-206 of the Code of the City of Fort Collins is hereby amended by the addition of the following definitions in alphabetical order: Sec. 26-206. Definitions. Incompatible (nonconventional) pollutant shall mean any nontreatable waste product or pollutant including nonbiodegradable dissolved solids. Excluded from this definition are the conventional pollutants such as BOO, COD, FOG, TOC, SS, ammonia, pH and fecal coliform bacteria. Normal domestic-strength wastewater shall mean wastewater which, when analyzed by standard methods, contains no more than two hundred fifty (250) mg/l of TSS, and three hundred (300) mg/l of COD, two hundred (200) mg/l of BOD, and/or one hundred (100) mg/l of TOC. Total organic carbon (TOC) shall mean the analytical measurement of organic carbon using methods specified in 40 CFR, Part 136, as amended. Wastewater strength surcharge shall mean the rate system used to charge intermediate nonresidential users and industrial users whose wastewater strength is higher than normal domestic strength in the parameters of BOO, COD, TOC, or TSS. Section 2. That Section 26-207(2) of the Code of the City is hereby amended by the addition of a new subparagraph (r) , with the remaining subparagraphs to be relettered accordingly, which new subparagraph (r) shall read as follows: Sec. 26-207. Terms and abbreviations. (2) Abbreviations: r. TOC shall mean total organic carbon; S. TTO shall mean total toxic organics; and t. USC shall mean United States Code. Section 3. That Section 26-278(5) is hereby amended to read as follows: Sec. 26-278. Classification of users. (5) Category E: Intermediate nonresidential users. An intermediate nonresidential user is a user listed in divisions A, B, D, E, and I of the SIC Manual who discharges domestic-type wastes with a strength in excess of any of the following parameters: a. COD greater than three hundred (300) mg/l ; b. Five-day BOD greater than two hundred (200) mg/l ; C. TOC greater than one hundred (100) mg/l ; or d. TSS concentration greater than two hundred fifty (250) mg/l . Section 4. That Categories E and F of Section 26-280 of the Code of the City are hereby amended to read as follows: Category C l a s s o f Rate Customer E Intermediate $1 .35 per 1,000 gallons of water use, and nonresident - measured wastewater flow, or winter quarter F ial user water use, whichever is applicable; plus a Significant surcharge of $0.779 per million gallons of i n d u s t r i a l each milligram per liter of suspended soils user in excess of 250 milligrams per liter; plus a surcharge of $0.628 per million gallons for each milligram per liter of BOD in excess of 200 milligrams per liter or a surcharge of $0.416 per million gallons for each milligram per liter of COD in excess of 300 milligrams per liter, or a surcharge of $1 .206 per million gallons for each milligram per liter of TOC in excess of 100 milligrams per liter, whichever is applicable. That Sections 26-281(a) and (c) of the Code of the City are hereby amended to read as follows: Sec. 26-281. Wastewater strength or industrial surcharge; categories. (a) Industrial and intermediate nonresidential users in categories E, F, G and H shall also be subject to a monthly surcharge for excessive strength of BOD, COD, TOC, and TSS in their discharged wastewater in addition to the base monthly service rate per volume of water consumed or volume of wastewater discharged. The surcharge rates shall be based on the extra costs incurred by the city in surveillance, sampling and testing of the discharges, for additional operating and maintenance expenses and for any other action required to identify, handle, process or supplement normal activities due to the excessive strength, plus overhead charges, and once established the rates shall be set for in §26-282. (c) The amount of the wastewater strength surcharge to be billed each user shall be calculated from one (1) of the following three (3) formulas, depending on whether the wastewater is more amenable to testing for BOO, COD, or TOC or on the selection of the Director in the absence of monitoring: (1) Cs = Vu [Bc(B) + Sc(S)] (2) Cs = Vu [CODc(COD) + Sc(S)] (3) Cs = Vu [TOCc(TOC) + Sc(S)] Where: Cs = User' s surcharge for wastewaters of excessive strength per billing period. Vu = Volume of water used or wastewater discharged per billing period. Bc = Cost of service for treatment of a unit of BOD. 3 B = Concentration of BOD from a user in excess of two hundred (200) mg/l . Sc = Cost of service for treatment of a unit of TSS. S = Concentration of TSS from a user in excess of two hundred fifty (250) mg/l . CODc = Cost of service for treatment of unit of COD. COD = Concentration of COD from a user in excess of three hundred (300) mg/l . TOCc = Cost of service for treatment of a unit of TOC. TOC = Concentration of TOC from a user in excess of one hundred (100) mg/l . Section 6. That Section 26-282(a) of the Code of the City is hereby amended to read as follows: Sec. 26-282. Wastewater strength or industrial surcharges and categories established.
