HomeMy WebLinkAbout032 - 04/20/1993 - AUTHORIZING THE SALE OF LOTS 1-8, BLOCK 7 AND LOT 24, BLOCK 6, REPLAT OF EVERGREEN PARK 2ND FILING ORDINANCE NO. 32, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE SALE OF LOTS 1-8, BLOCK 7 AND LOT 24, BLOCK 6, REPLAT OF EVERGREEN PARK 2ND FILING WHEREAS, pursuant to Section 20-44 of the City Code, the City of Fort Collins removed weeds and rubbish from Lots 1-8, Block 7 and Lot 24, Block 6, Replat of Evergreen Park 2nd Filing (the "Property") , which is shown on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the City has assessed the costs of such removal against the Property; and WHEREAS, the owner of the Property did not pay said assessment within thirty days of the date of certification and billing thereof; and WHEREAS, pursuant to Section 20-44(c) of the City Code, the Financial Officer of the City certified to the County Treasurer that the assessments against the Property were delinquent and should be collected in the same manner as general taxes; and WHEREAS, the Property was advertised and sold by the Larimer County Treasurer at the 1987 and 1988 tax sales, and Treasurer's Deeds for the Property were subsequently issued to the City; and WHEREAS, the City has recently been contacted by the owner of the rest of the Evergreen Park Subdivision, R. J. Develco, Inc. ; and WHEREAS, R. J. Develco, Inc. has made an acceptable bid for the purchase of the Property in the amount of Twenty-two Thousand Five Hundred Dollars ($22,500) ; and WHEREAS, under Section 23-111(a) of the Code, the Council is authorized to sell real property owned in the name of the City, provided it first finds the sale is in the best interest of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the sale of Lots 1-8, Block 7 and Lot 24, Block 6, Replat of Evergreen Park 2nd Filing to R. J. Develco, Inc. for the sum of Twenty-two Thousand Five Hundred Dollars ($22,500) is in the best interests of the City. Section 2. That said amount represents the fair market value of the Property. Section 3. That the Mayor be, and hereby is, authorized to execute such agreements of sale and documents of conveyance as are necessary for the City to sell and convey the Property described above to R. J. Develco, Inc. on the terms and conditions described above.
