HomeMy WebLinkAbout177 - 01/04/1994 - AUTHORIZING QUIT CLAIM DEED BETWEEN THE CITY AND GINO CAMPANA ORDINANCE NO. 177, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED BY AND BETWEEN THE CITY OF FORT COLLINS AND GINO CAMPANA WHEREAS, on January 1, 1960, Chris Rasmussen executed a quit claim deed "to the Public for road and rights-of-way purposes," and recorded said deed September 28, 1960, at Book 1125, Page 486 of the Larimer County, Colorado Records; and WHEREAS, said deed does not constitute a proper dedication of property to the City and was never accepted by the City of Fort Collins; and WHEREAS, no public street improvements were constructed on said parcel ; and WHEREAS, the City has not claimed to have any interest in the parcel of real property described in said deed, nor is any such interest necessary or desirable for future public access on or across said parcel ; and WHEREAS, in order to clear the title to the property, it is necessary and desirable that the City execute a quit claim deed, relinquishing any claim it may have to the property; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the execution of the proposed quit claim deed by and between the City and Gino Campana. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute a quit claim deed by and between the City of Fort Collins, Colorado, a municipal corporation and Gino Campana for that parcel more particularly described on Exhibit "A" attached hereto and incorporated herewith.
