HomeMy WebLinkAbout175 - 01/04/1994 - AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE UTILITY EASEMENT TO PUBLIC SERVICE COMPANY OF COLORADO ORDINANCE NO. 175, 1993 O, FHE COUNCIL OF THE CITY OF FORT _JLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE UTILITY EASEMENT TO PUBLIC SERVICE COMPANY OF COLORADO WHEREAS, the City of Fort Collins is the owner of the unplatted storm drainage detention area along Skyline Drive and West Elizabeth Street in Larimer County, Colorado; and WHEREAS, Public Service Company of Colorado wishes to acquire a non- exclusive easement interest in the property to construct, operate, maintain, repair and replace a gas main; and WHEREAS, under Section 23-111 of the City Code, the City Council must find by Ordinance that any sale or other disposition of real property owned by the City is in the best interest of the City and must also find that the sale or disposition will not materially impair the viability of the utility system as a whole if the property is part of the system and that the sale will be for the benefit of the citizens of the City; and WHEREAS, the value of the easement, based on the City's purchase price of the property, is $2,443.34. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the above-described sale and conveyance of an easement interest in the Property is in the best interests of the City of Fort Collins. Section 2. That the Council finds that the sale of this easement will not materially impair the viability of the City's storm drainage utility system as a whole and will be for the benefit of the citizens of the City. Section 3. That the Mayor is authorized to execute an agreement conveying a non-exclusive easement interest for a gas main to Public Service Company of Colorado over, on and under the real property described on the attached Exhibit "A, " which is incorporated herein by this reference, for the amount of Two Thousand Four Hundred Forty-three Dollars and Thirty-four Cents ($2,443.34) .
