HomeMy WebLinkAbout017 - 02/16/1993 - AMENDING CITY CODE PERTAINING TO CONFLICT OF INTEREST COMPLAINTS ORDINANCE NO. 17, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 2, ARTICLE V, OF THE CODE PERTAINING TO CONFLICT OF INTEREST COMPLAINTS WHEREAS, under Section 2-569(1) of the City Code, any person who believes that a councilmember or a board or commission member has violated any provision of state law or the Charter or Code pertaining to ethical conduct may file a complaint with the Mayor; and WHEREAS, any such complaint is to be placed on the agenda for the next special or regular City Council meeting for review and possible action by the City Council , including, without limitation, review by the Council Ethics Review Board; and WHEREAS, in the event that a particular complaint is filed against four or more councilmembers, the City Council may be unable to obtain a quorum to determine, as required by the foregoing Section of the Code, what action should be taken with regard to the complaint; and WHEREAS, the Council wishes to amend the Code so as to provide an alternative procedure for obtaining an advisory opinion and recommendation regarding any such complaints. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 2-569 of the Code of the City is hereby amended by the addition of a new subparagraph (d) (1)c, to read as follows: Sec. 2-569. Board of Ethics. (d) (1) c. In the event that a complaint is filed with the Mayor under the provisions of this subsection which alleges a violation on the part of four (4) or more councilmembers, such complaint shall not be referred to the Council for review but shall instead be submitted to an alternate review board. Said board shall consist of any remaining councilmembers who are not named in the complaint and as many members of city boards and commissions as are necessary to constitute a seven (7) member board. Said board and commission members shall be selected at random by the City Clerk within ten (10) working days of the date upon which the complaint is filed with the Mayor. Any board and commission members selected by the City Clerk who elect not to serve on the alternate review board shall immediately so notify the City Clerk, who shall thereafter select as many additional board and commission members as are necessary to constitute the seven (7) member board. The procedure utilized by the alternate review board for reviewing the complaint and rendering an advisory opinion and recommendation shall be as provided in subparagraph (e) below.
