OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE RIGHT-OF-WAY FOR BRITTANY DRIVE
AS DEDICATED BY DEED IN CONNECTION WITH S.I.D. #81
WHEREAS, Special Improvement District #81 included a dedication to the
public by deed of a right-of-way for Brittany Drive; and
WHEREAS, the Planning and Zoning Board has approved a plat entitled
"Provincetowne P.U.D. , Filing One" which plats property abutting said right-of-
way for Brittany Drive; and
WHEREAS, said plat dedicates rights-of-way and easements to the public and
requires the vacation of certain portions of the original right-of-way dedicated
for Brittany Drive more particularly described on Exhibit "A," attached hereto
and incorporated herewith; and
WHEREAS, said portions of the Brittany Drive right-of-way are no longer
necessary or desirable to retain for street intersection purposes due to the
platting of new street rights-of-way associated with the Provincetowne P.U.D. ,
Filing One; and
WHEREAS, pertinent City agencies and private utility companies have been
contacted and report no objection to the proposed vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said rights-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the portions of street rights-of-way for Brittany Drive, more particularly
described on Exhibit "A," attached hereto and incorporated herewith, are hereby
vacated, abated and abolished.
Introduced, considered favorably on First Reading, and ordered published
this 7th day of December, A.D. 1993, and to be presented for final passage on the
21st day of December, A.D. 1993.

The following three parcels of land located in the Northeast
Quarter of Section 13, Township 6 North, Range 69 West of the 6th
P.M. Larimer County, Colorado, which considering the North line
of said Northeast Quarter as bearing North 88 degrees, 17
minutes, 23 seconds West, and with all bearings contained herein
relative thereto, are more particularly described as follows:
Commencing at the Northeast corner of said Section 13; thence
South 34 degrees, 54 minutes, 47 seconds West. 1850.27 feet to a
point of a curve concave to the Northwest, having a central angle
of 93 degrees, 06 minutes, 05 seconds, a radius of 20.00 feet,
the long-chord of which bears South 42 degrees. 17 minutes, 17
seconds West, 29.04 feet, said point being the TRUE POINT OF
BEGINNING; thence Southwesterly along the arc of said curve 32.50 V
feet; thence tangent from said curve South 06 degrees, 27
minutes, 21 seconds East, 54.22 feet to a point of a tangent
curve concave to the Southwest, having a central angle of 87
degrees, 09 minutes, 13 seconds, a radius of 20.00 feet, the
long-chord of which bears South 47 degrees, 50 minutes, 22
seconds East, 27.57 feet; thence Southeasterly along the arc of
said curve 30.42 feet; thence North 04 degrees, 15 minutes, 45
seconds West, 94.12 feet to the POINT OF BEGINNING.
ALSO:
Commencing at the Northeast corner of said Section 13; thence
South 31 degrees, 21 minutes, 02 seconds West, 1880. 13 feet to a
point of a. curve concave to the Southeast having a central angle
of 87 degrees, 08 minutes. 55 seconds, a radius of 20.00 feet,
the long-chord of which bears North 39 degrees. 18 minutes, 43
seconds East, 27.57 feet. said point being the TRUE POINT OF
BEGINNING; thence Northeasterly along the arc of said curve 30.42
feet; thence tangent from said curve North 02 degrees. 04
minutes, 08 seconds West, 54.22 feet to a point of a curve
concave to the Northeast having a central angle of 93 degrees, 05
minutes, 46 seconds, a radius of 20.00 feet, the long-chord of
which bears North 50 degrees, 48 minutes. 38 seconds West, 29.04
feet, thence Northwesterly along the arc of said curve 32.50
feet; thence South 04 degrees, 15 minutes. 45 seconds East, 94.13
feet to the POINT OF BEGINNING.

Commencing at the Northeast corner of said Section 13, thence
South 40 degrees, 40 minutes, 02 seconds West, 1525.92 feet to a
point of a curve concave to the Southeast having a central angle
of 90 degrees, 00 minutes, 00 seconds, a radius of 20.00 feet,
the long-chord of which bears North 46 degrees, 42 minutes, 37
seconds East, 28.28 feet, said point being the TRUE P01NT OF
BEGINNING; thence Northeasterly along the arc of said curve 31.42
feet; thence tangent from said curve North 01 degrees, 42
minutes, 37 seconds East, (which was previously recorded
erroneously at keception No. 88013686 as North 01 degrees, 42
minutes, 37 seconds West) . 30.00 feet to a point of a curve
concave to the Northeast having a central angle of 90 degrees, 00
minutes, 00 seconds, a radius of 20.00 feet, the long-chord of
which bears North 43 degrees, 17 minutes, 23 seconds West, 28.28
feet, thence Northwesterly along the arc of said curve 31.42
feet; thence South 01 degrees, 42 minutes, 37 seconds West, 69.99
