OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY
AND APPROPRIATING UNANTICIPATED REVENUE
TO THE PARKLAND FUND
WHEREAS, the City of Fort Collins is the owner of a .7 acre 25 foot wide tract of land
abutting the northern boundary of Lots I through 18, Block 5, Wagonwheel Filing No. 2 (the
"Property") shown on attached Exhibit "A" which is incorporated herein by this reference; and
WHEREAS, the Property has been used as a drainage ditch for Rossborough Park; and
WHEREAS,the Property is no longer needed by the City but the City is presently responsible
for maintaining this Property; and
WHEREAS, Council approved the sale of the south half of the Property, containing
approximately .351 acres, to the various landowners of the lots abutting the Property, by Ordinance
No. 35, 1995; and
WHEREAS, the City now wishes to sell the north half of the Property, containing
approximately .351 acres, to the same abutting lot owners who will be purchasing the south half of
the Property, as follows:
(1) Sale to Jerome I. Smith for $72.02 for the northerly 12.5-foot wide strip of
the 25-foot strip abutting the north of Lot 18 of Block 5 Wagon Wheel Filing

(2) Sale to Kevin A. Vaughan for$148.66 for the northerly 12.5-foot wide strip
of the 25-foot strip abutting the north of Lot 17 of Block 5 of Wagon Wheel
Filing No. 2
(3) Sale to James Dennis Ozee and Deana J. Ozee for $108.51 for the northerly
12.5-foot wide strip of the 25-foot strip abutting the north of Lot 16 of Block
5 of Wagon Wheel Filing No. 2
(4) Sale to Donald L. Pratt and Cindy Pratt for $100.98 for the northerly 12.5-
foot wide strip of the 25-foot strip abutting the north of Lot 15 of Block 5 of
the Wagon Wheel Filing No. 2
(5) Sale to William J. Pranskevich for $99.48 for the northerly 12.5-foot wide
strip of the 25-foot strip abutting the north of Lot 14, Block 5 of the Wagon
Wheel Filing No. 2
(6) Sale to Lanny W. Reed and Rebecca G. Reed for $100.98 for the northerly
12.5-foot wide strip of the 25-foot wide strip abutting the north of Lot 13 of
Block 5 of the Wagon Wheel Filing No. 2
(7) Sale to Michael Geheb and Marcia Geheb for $99.48 for the northerly 12.5-
foot wide strip of the 25-foot strip abutting the north of Lot 12 of Block 5 of
the Wagon Wheel Filing No. 2
(8) Sale to Brad E. Eaton and Julie Snyder-Eaton for $100.98 for the northerly
12.5-foot wide strip of the 25-foot strip abutting the north of Lot 11 of Block
5 of the Wagon Wheel Filing No. 2
(9) Sale to Blake Dieters for$100.98 for the northerly 12.5-foot wide strip of the
25-foot strip abutting the north of Lot 10 of Block 5 of the Wagon Wheel
Filing No. 2
(10) Sale to David Stinar and Susan J. Stinar for$99.48 for the northerly 12.5-foot
wide strip of the 25-foot strip abutting the north of Lot 9 of Block 5 of
Wagon Wheel Filing No. 2
(11) Sale to Gary C. Olsen and Anna L. Olsen for$99.48 for the northerly 12.5-
foot wide strip of the 25-foot strip abutting the north of Lot 8 of Block 5 of
the Wagon Wheel Filing No. 2
(12) Sale to Jim Veggian and Irene Veggian for $100.98 for the northerly 12.5-
foot wide strip of the 25-foot strip abutting the north of Lot 7 of Block 5 of

(13) Sale to Gregory R. Bruny and Ruth Ann Bruny for $99.48 for the northerly

(14) Sale to Steve Sagmeister and Renay Sagmeister for $97.97 for the northerly

(15) Sale to Kevin Lawson for$99.48 for the northerly 12.5-foot wide strip of the
25=foot strip abutting the north of Lot 4 of Block 5 of the Wagon Wheel
Filing No. 2
(16) Sale to Arlene F. Mededog for $97.97 for the northerly 12.5-foot wide strip
of the 25-foot strip abutting the north of Lot 3 of Block 5 of the Wagon
Wheel Filing No. 2
(17) Sale to Keith A. Rutledge and Brenda G. Rutledge for $99.48 for the
northerly 12:5-foot strip of 25-footstrip abutting the north of Lot2
of Block 5 of the Wagon Wheel Filing No. 2
(18) Sale to William R. Hunt and Irene Hunt for$124.97 for the northerly 12.5-
foot wide strip of the 25-foot strip abutting the north of Lot 1 of Block 5 of
the Wagon Wheel Filing No. 2; and
WHEREAS, the price for the sale of the Property is based on the City's purchase price; and
WHEREAS, Section 23-111 of the City Code requires that the Council authorize the sale,
conveyance or other disposition of any and all interests in real property owned in the name of the
City and first find,by ordinance,that such sale or other disposition is in the best interests of the City;
and
WHEREAS, Article V, Section 14 of the City Charter authorizes Council to appropriate
unanticipated revenues that result from new revenue sources at any time during the budget year.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council hereby finds that the sale of the Property, to the persons
described above and for the amounts stated above, is in the best interests of the City.
Section 2. That the proceeds from the sale in the amount of$1,851.36 is hereby appropriated
to the Parkland Fund for the Stewart Case Park Project.
Section 3. That the Mayor be, and hereby is, authorized to execute such agreements of sale
and documents or conveyance as are necessary for the City to sell and convey the Property to the
above named individuals on the terms and conditions described above.
