HomeMy WebLinkAbout050 - 05/16/1995 - DEDICATING 1.62 ACRES OF LAND AS A PUBLIC HIGHWAY FOR IMPROVEMENTS TO COUNTY ROAD 23 (CENTENNIAL DRI ORDINANCE NO. 50, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS DEDICATING 1.62 ACRES OF LAND AS A PUBLIC HIGHWAY FOR IMPROVEMENTS TO COUNTY ROAD 23 (CENTENNIAL DRIVE) WHEREAS, the City of Fort Collins is the owner of certain land adjacent to County Road 23 (Centennial Drive) and known as Pine Ridge Open Space; and WHEREAS, Latimer County's "Short Range Highway Improvement Program" includes improvements to Centennial Drive along the east side of Horsetooth Reservoir (the "Project"); and WHEREAS, the County has requested that the City dedicate 1.62 acres of land to be used as a public highway in connectiorrwith the Project,which:and is described onExhibit "A", attached_ hereto and incorporated herein by this reference; and WHEREAS,the Project will benefit the citizens of Fort Collins by improving safe access to Pine Ridge Open Space; and WHEREAS,the County, as part of the Project, will also improve parking for persons using the Pine Ridge Open Space; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interests of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That the above-described sale and conveyance of land is in the best interest of the City of Fort Collins and furthers the public purpose of improving the safety of public roads and improving access to, and parking for, Pine Ridge Open Space. Section 2. That the Mayor is authorized to execute a Deed of Dedication dedicating to Latimer County the real property described on Exhibit "A" as a public highway to be used-to- improve County Road 23. Mayor ATTEST: City Clerk EXHIBIT "A" That portion of the southwest quarter of Section 29 and the North half of the North half of Section 32, Township 7 North, Range 69 West of the Sixth Principal Meridian, Latimer County, Colorado described as follows: Considering the line between Angle Point (AP) 39 (found B.L.M. brass cap) and Angle Point (AP) 40 (found B.L.M. brass cap) as bearing North 88 degrees 26 minutes 00 seconds East and with all bearings contained herein relative thereto. All references to Angle Points (AP's) are to those corners establisbe& by the- United States Department of the Interior, Bureau of Land Management- "Dependent Resurvey and Survey of Township 7 North, Range 69 West of the Sixth Principal Meridian. Accepted April 16, 1954" as shown on the official plat thereof. The above described parcel contains 1.62 acres more or less.
