HomeMy WebLinkAbout040 - 04/05/1994 - AUTHORIZING A NONEXCLUSIVE TEMPORARY TURNAROUND EASEMENT TO STORCK DEVELOPMENT CORPORATION ORDINANCE NO. 40, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE TEMPORARY TURNAROUND EASEMENT TO STORCK DEVELOPMENT CORPORATION WHEREAS, the City of Fort Collins is the owner of an unplatted area South of Drake Road and west of Taft Hill Road in Larimer County, Colorado; and WHEREAS, Storck Development Corporation wishes to acquire a non-exclusive, temporary turnaround easement as described in Exhibit "A" ; and WHEREAS, under Section 23-111 of the City Code, the City Council must find by Ordinance that any sale or other disposition of real property owned by the City is in the best interest of the City and, with respect to real property which is a part of the City's water or utility system, must also find that the sale or disposition of the same will not materially impair the viability of said utility system as a whole and that it will be for the benefit of the citizens of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the sale and conveyance of a non-exclusive, temporary turnaround easement in the Property (described on attached Exhibit "A" which is incorporated herein by this reference) is in the best interests of the City of Fort Collins. Section 2. That the Council finds that the sale of this non-exclusive temporary turnaround easement will not materially impair the viability of the City's Light and Power utility system as a whole and will be for the benefit of the citizens of the City. Section 3. That the Mayor is hereby authorized to execute an agreement conveying a non-exclusive temporary easement for a turnaround to Storck Development Corporation over, on and under the real property described on the attached Exhibit "A." The center of said turnaround is located as follows: A point located in the Northeast Quarter of Section 28, Township 7 North, Range 69 West of the Sixth P.M. , Larimer County, Colorado, which considering the North line of the said Northeast Quarter as bearing South 88 degrees 41 minutes 00 seconds West and with all bearings contained herein relative thereto. Beginning at the Northeast corner of said Section 28; thence along the North line of said Northeast Quarter South 88 degrees 41 minutes West 230.00 feet; thence South 30.00 feet to a point on the South line of West Drake Road; thence along the boundary of a tract of land described in Book 2156 at page 169 in the Larimer County Clerk and Recorder's Office, South 88 degrees 41 minutes 00 seconds West 400.00 feet, and again South 197.06 feet; thence North 88 degrees 41 minutes East 42.70 feet to said center point of the temporary turnaround.
