ORDINANCE NO. 3, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE A GRANT OF EASEMENT IN FAVOR OF BURNS RANCHES, INC. WHEREAS, the City of Fort Collins is the owner of that certain parcel of real property located in Larimer County, Colorado, known as- tir'r Quail Hollow 1th Filing ("the Property") ; and WHEREAS, Burns Ranches, Inc. wishes to acquire a non-exclusive emergency access easement across and through the Property for emergency access for the Burns Ranch at Quail Ridge development; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell , convey or otherwise dispose of real property owned by the City, provided the Council first finds- by ordinance that any sale or other disposition of real property owned by the City is in the best interest of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the conveyance of a non-exclusive emergency access easement across and through the Property for the purpose of providing emergency access to Burns Ranches, Inc. is in the best interests of the City of Fort Collins. Section 2. That the Mayor be, and hereby is, authorized to execute the Grant of Easement, attached hereto as Exhibit "A, " and incorporated herein by this reference, conveying a non-exclusive emergency access easement to Burns Ranches, Inc.
