HomeMy WebLinkAbout026 - 04/03/1990 - AMENDING CITY CODE RELATING TO EXCEPTIONS TO NOISE LEVELS ORDINANCE NO. 26, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 20-25(a) OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO EXCEPTIONS TO NOISE LEVELS WHEREAS, Article II, Chapter 20 of the Code of the City of Fort Collins addresses nuisances which are created by unreasonable noise; and WHEREAS, nuisance noises include noises which exceed adopted decibel levels as well as unreasonable noises as witnessed and determined by the Police Department; and WHEREAS, Section 20-25 of the Code describes certain noises which shall not be deemed to be nuisances in any case, including those emanating from authorized emergency vehicles, aircraft and other activities subject to federal noise control and the unamplified human voice; and WHEREAS, the City Council desires to declare that the unamplified human voice may constitute a nuisance whenever it exceeds the applicable decibel level or is determined to be a nuisance by a member of the Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 20-25(a) of the Code of the City of Fort Collins is hereby amended to read as follows: (a) The provisions of this Article shall not apply to: (1) Any noise resulting from any authorized emergency vehicle in responding to an emergency call or acting in time of emergency; (2) The operation of aircraft or other activities which are subject to federal law with respect to noise control .
