HomeMy WebLinkAbout073 - 07/07/1992 - AUTHORIZING THE LEASE BY MESA AIRWAYS, INC., D/B/A/ UNITED EXPRESS AIRLINES AT FORT COLLINS LOVELAND ORDINANCE NO. 73, 1992 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CERTAIN PROPERTY AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT BY MESA AIRWAYS, INC. , d/b/a UNITED EXPRESS AIRLINES WHEREAS, the Cities of Loveland and Fort Collins, Colorado ("Cities") jointly own and operate the Fort Collins-Loveland Municipal Airport ("Airport") ; and WHEREAS, Mesa Airways, Inc. , d/b/a United Express Airlines ("United Express") has proposed to lease certain Airport property from the Cities subject to completion of a terminal building and related improvements for the principal purpose of conducting commercial air transportation service at the Airport; and WHEREAS, the Cities desire to enter into this lease in order to provide air transportation services for the Cities and their visitors; and WHEREAS, the Council finds, in accordance with Section 23-114 of the Code of the City of Fort Collins, that the proposed Airline Use and Lease Agreement with United Express is in the best interests of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Airline Use and Lease Agreement proposed for execution by the Cities and United Express is in the best interests of the City of Fort Collins. Section 2. That the Mayor be, and hereby is, authorized to enter into an Airline Use and Lease Agreement with United Express. Such Agreement shall be substantially similar to that certain Airline Use and Lease Agreement executed on August 17, 1990, between the Cities and Rocky Mountain Airways, Inc. , d/b/a Continental Express, except that: (1) the termination of the Agreement shall coincide with the termination of the Continental Express Lease, (2) the frequency of scheduled airline service shall be not less than three (3) flights per day, (3) the schedule of rents and fees shall conform to those in effect for Continental Express, and (4) the re-evaluation provisions shall be changed to allow service to cease or be modified after three (3) months of operation. Section 3. The City Manager is further authorized to make additional modifications to the form of the Lease Agreement which are necessary to make the lease applicable to United Express and to separately define the portions of the leased premises to be used by United Express, such as provisions pertaining to the description of the "Exclusive Use Area" to be assigned to United Express and parking positions on the Airport ramp. Introduced, considered favorably on first reading, and ordered published this 2nd day of June, A.D. 1992, and to be presented for final passage the 7th day of July A.D. 1992.
