HomeMy WebLinkAbout053 - 05/05/1992 - VACATING A PORTION OF THE SOUTHRIDGE GREENS RIGHT-OF-WAY ON THE PARAGON POINT PUD AND A PORTION OF S ORDINANCE NO. 53, 1992 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE SOUTHRIDGE GREENS BOULEVARD RIGHT-OF-WAY ON THE PARAGON POINT P.U.D. AND A PORTION OF SOUTHRIDGE GOLF COURSE WHEREAS, the Planning and Zoning Board of the City of Fort Collins has approved the plats entitled the "First Replat of the Paragon Point Planned Unit Development" and the "First Replat of a Portion of Tract A, Southridge Golf Course" ; and WHEREAS, approval of said replats has made it necessary and desirable that the City vacate a portion of the Southridge Greens Boulevard right-of-way previously dedicated at Book 2288, Page 0833 of the Larimer County Clerk and Recorder and a portion as dedicated by the plat of Paragon Point Planned Unit Development, as more particularly described below; and WHEREAS, pertinent City agencies and private utility companies have been contacted and report no objection to the proposed vacation; and WHEREAS, there will be no cost to the City in making the proposed vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said street right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that a portion of the Southridge Greens Boulevard right-of-way more particularly described on Exhibits "A" , "B" , and "C" , attached hereto and incorporated herewith, be, and the same hereby is, vacated, abated, and abolished, subject to the reservations of easements for utility purposes more particularly described on Exhibits "D", "E" and "F" , attached hereto and incorporated herewith. Introduced, considered favorably on first reading, and ordered published on this 21st day of April , A.D. 1992, and to be presented for final passage on the 5th day of May, A.D. 1992.
