OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM
EXISTING PROJECTS IN THE CAPITAL PROJECTS FUND AND
APPROPRIATING UNANTICIPATED REVENUE TO CREATE A 1995
PEDESTRIAN ACCESSIBILITY PROJECT
WHEREAS, City staff recently formed a task team to identify opportunities to better serve
the needs of pedestrians based on: (1) the increasing emphasis on alternate modes of transportation;
and (2) the requirements of the Americans with Disabilities Act (ADA); and
WHEREAS, at a Council worksession on January 10, 1995, Staff presented the
recommendations of the task team regarding pedestrian accessibility; and
WHEREAS, the report from the task team noted that pedestrian improvements are currently
constructed in conjunction with several capital projects, including-Pedestrian Access Ramps, the
Annual Concrete Program (50150 sidewalk project), and Minor Street Capital; and
WHEREAS, one of the four recommendations of the task team was to combine the funds
from the aforementioned projects to create a more focused and effective pedestrian accessibility
effort; and
WHEREAS, funds totalling $400,000 could be made available for pedestrian improvements
by combining the existing project appropriations; and
WHEREAS, Article V, Section 14 of the Charter of the City of Fort Collins, (the "Charter")
authorizes the City Council to transfer by ordinance any unexpended appropriated amounts or
portion thereof from one fund to another upon the recommendation of the City Manager, provided
that the purpose for which the transferred funds are to be expended remains unchanged or the
purpose for which the funds were initially appropriated no longer exists; and
WHEREAS,the City Manager has recommended that the amounts in the Pedestrian Access
Ramp Capital Project,in the Concrete Program and in the Minor Street Capital Project be transferred
to the newly created Pedestrian Accessibility Capital Project in the Capital Project Fund; and
WHEREAS, the purpose for which these transferred funds are to be expended remains
unchanged; and
WHEREAS, as further recommended in the task team's report, the annual 50/50 sidewalk
project should be modified so that funds from this program are used for sidewalk improvements in
locations where such improvements are most needed for pedestrian safety and accessibility; and
WHEREAS, the total amount of revenue to be received from participating property owners
in the 1995 50/50 sidewalk program is estimated to be $40,000; and
WHEREAS, Article V, Section 14, of the Charter authorizes the City Council to appropriate
by ordinance unanticipated revenue received as a result of rate or fee increases or new revenue
sources at any time during the budget year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the unexpended appropriated amount of THIRTY-THREE THOUSAND
FOUR HUNDRED SIXTY-FIVE ($33,465) be authorized for transfer from the Pedestrian Access
Ramps capital project in the Capital Projects Fund to the newly created Pedestrian Accessibility
capital project in the Capital Projects Fund.
Section-2. That theunexpended-appropriated-amount-of TWO TTUNDRED-EIGHTY-TWO
THOUSAND TWO HUNDRED EIGHTY-SIX ($282,286) be authorized for transfer from the
Concrete Program capital project in the Capital Projects Fund to the newly created Pedestrian
Accessibility capital project in the Capital Projects Fund.
Section 3. That the unexpended appropriated amount of EIGHTY-FOUR THOUSAND
TWO HUNDRED FORTY-NINE($84,249)be authorized for transfer from the Minor Street Capital
project in the Capital Projects Fund to the newly created Pedestrian Accessibility capital project in
the Capital Projects Fund.
Section 4. That there is hereby appropriated for expenditure from unanticipated revenue in
the Capital Projects Fund, for the newly created Pedestrian Accessibility Capital Project the sum of
FORTY THOUSAND ($40,000) received from participants in the Annual Concrete Improvement
Program to be used during the year 1995 for the Annual Concrete Improvement program.
Section 5. That the aforementioned $40,000 appropriation in Section 4 above is contingent
upon the City's actual receipt of the revenue referred to therein, and the amounts appropriated under
Section 4 shall in no event exceed the amounts actually received by the City during the year 1995
from property owners participating in the Annual Concrete program.
