HomeMy WebLinkAbout139 - 11/21/1995 - AUTHORIZING THE SALE OF 720 NORTH WOOD ORDINANCE NO. 139, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY AT 720 N. WOOD WHEREAS,on May 6, 1983, the City purchased property in the vicinity of the Water Utility (the "Property"), more particularly described in the attached Exhibit A, incorporated herein by this reference, in anticipation of the Utility's's future expansion needs; and WHEREAS, a one-thousand square foot metal building (the "Metal Building"), previously used as Bob's Appliance Shop, was located on the Property at the time of said purchase and has remained on the Property as depicted on Exhibit B on file in the office of the City Clerk, and incorporated herein bythis reference; and WHEREAS, since 1983 the Water Utility and other City departments have made use of the Metal Building as a training facility, pending the anticipated expansion onto the Properly; and WHEREAS, the Property is now needed by the Water Utility for the previously planned expansion; and WHEREAS,the Metal Building no longer serves a useful purpose for either the Water Utility or for other City departments, and relocation of the Metal Building for possible City use has been determined not to be cost-effective; and WHEREAS, under Section 23-I11(a) of the Code, the Council is authorized to sell real property owned in the name of the City, provided it first finds the sale is in the best interest of the City; and WHEREAS, Section 23-112 of the Code defines real property to include buildings and other permanent structures, along with the land on which they are situated; and WHEREAS, under Section 23-1 1 l(b) of the Code, with respect to real property which is a part of the city s water or utility systems, the City Council must also find that the disposition will not materially impair the viability of the particular utility system as a whole and that it will be for the benefit of the citizens of the City; and WHEREAS, the City has issued Request for Bids No. 4969 seeking buyers for all of a Metal Building at 720 N. Wood; and WHEREAS, in response thereto, the City has received an acceptable bid from A-One Housemoving in the amount of Seven Hundred Fifty Dollars ($750.00) for the Metal Building. NOW,THEREFORE, BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the sale of the Metal Building to A-One Housemoving for the sum of Seven Hundred Fifty Dollars ($750.00) is in the best interests of the City and that said amount is the best price obtainable by the City for the Metal Building and represents the fair market value thereof. Section 2. That the sale of the Metal Building will not impair the viability of the Water Utility as a whole, and will be for the benefit of the citizens of the City. Section 3. That the Mayor be, and hereby is, authorized to execute such agreements of sale and documents of conveyance as are necessary for the City to sell and convey the Metal Building on the terms and conditions described above.
