OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE STREET RIGHT-OF-WAY
FOR CENTRE AVENUE IN THE CENTRE
FOR ADVANCED TECHNOLOGY P.U.D.
WHEREAS, on May 22, 1995 the Planning and Zoning Board approved the P.U.D. and plat
entitled "Centre For Advanced Technology P.U.D., 17th Filing" (the P.U.D.); and
WHEREAS, the Owner of said P.U.D. has requested that the City vacate a portion of the
right-of-way for Centre Avenue more particularly described below; and
WHEREAS, said portion of right-of-way was originally dedicated for the intersection of a
future street planned to serve the P.U.D., and
WHEREAS,the Owner of the P.U.D.has chosen to design and construct a network of private
access drives dedicated as public and emergency access easements to provide vehicular circulation
on site; and
WHEREAS,the design and construction of said private access drives eliminates the need for
a public street for site access and circulation; and
WHEREAS, the portion of Centre Avenue right-of-way dedicated for the old street
intersection-is-no longer necessary-or desirable to retain forpublic-street_pugzocec-and
WHEREAS, all public and private utility agencies, the Poudre Fire Authority, and the City
Transportation Department have been notified of the proposed vacation and report no objection; and
WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said right-of-way.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portion of right-of-way for Centre Avenue dedicated upon the plat entitled
"Centre for Advanced Technology P.U.D., 15th Filing" and more particularly described as follows,
to wit:
A tract of land situate in the Southwest 1/4 of Section 23,Township 7 North,Range 69 West
of the P.M., City of Fort Collins, County of Larimer, State of Colorado, which, considering
the West line of said Southwest 1/4 as bearing N 00°15'22" E and with all bearings
contained herein relative thereto, is contained within the boundary lines which begin at a
point on the southerly right-of-way line of Centre Avenue which bears N 00°15'22"E 975.26
feet, and again S 89°44'38" E 489.54 feet, and again N 84°38'47" E 417.46 feet from the
Southwest comer of said Section 23, and run thence along the arc of an 11.00 foot radius
curve to the right a distance of 17.16 feet,the long chord of which bears S 54°02'17" E 15.47
feet; thence N 80°39'20" E 54.00 feet; thence along the arc of an 11.00 foot radius curve to
the right a distance of 17.16 feet, the long chord of which bears N 35°20'38" E 15.47 feet to
the southerly right-of-way line of Centre Avenue; thence along said southerly right-of-way
line along the arc of a 3542.38 foot radius curve to the right a distance of 75.76 feet,the long
chord of which bears S 80°39'20"W 75.76 feet to the point of beginning.
